HomeMy WebLinkAboutResolution - 3391 - Right Of Way Offer- WG Mcmillan Jr.- 34Th St Widening, Sec 43, Block A-K - 06/14/1990 (2)Resolution # 3391 June 14, 1990 Item #20 JWF:dw RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for the widening of 34th Street, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to --wit: TRACT 1 FIELD NOTE DESCRIPTION on a 21,360 square feet tract of land out of Section 43, Block A-K, Lubbock County, Texas, and being more particularly described as follows: BEGINNING at a R.R. spike, found at the Southeast corner of said Section 43, for the Southeast and beginning corner of this tract; THENCE North 87'38,45" West, along the South line of said Section 43, 427.29 feet to a R.R. spike, set for the Southwest corner of this tract; THENCE North 02°21,15" East, 55.00 feet to a 1/2" iron rod, set for the Northwest corner of this tract; THENCE South 86012,52" East, 399.52 feet to a 1/2" iron rod, set for the P.C. of a curve to the left; THENCE Northwesterly along the arc of said curve, an arc distance of 34.61 feet to a set R.R. spike, said curve has a radius of 30.00 feet, a central angle of 66006,30", tangent lengths of 19.52 feet, and a chord that bears North 60°43,53" East, 32.73 feet; THENCE South 02020,13" West, along the East line of said Section 43, 62.18 feet to the POINT OF BEGINNING. CONTAINING: 21,360 square feet. (0.490 Acres) 1111:«11PA FIELD NOTE DESCRIPTION on a 6,194 square feet tract of land out of Section 43, Block A-K, Lubbock County, Texas, and being more particularly described as follows: BEGINNING at a R.R. spike, set in the East line of said Section 43, for the Most Southerly and beginning point of this tract, whence a R.R. spike, found at the Southeast corner of said Section 43 bears South 02020,13" West, 105.40 feet; THENCE North 03*22,11" West, 180.47 feet to a 1/2" iron rod, set for a corner of this tract; THENCE North 00'30'26" West, 200.25 feet to a 1/2" iron rod, set for a corner of this tract; THENCE South 87042104" East, 27.88 feet to a R.R. spike, set in the East line of said Section 43, for the Northeast corner of this tract; THENCE South 02020,13" West, along the East line of said Section 43, 379.59 feet to the POINT OF BEGINNING. CONTAINING: 6,194 square feet. (0.142 Acres) SECTION 2. THAT the owners of said tract, including W. G. McMillan, Jr., BE offered through the Right -of -Way Department of the City of Lubbock the amount of $6,320.00, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
