HomeMy WebLinkAboutResolution - 2022-R0325 - Downtown Permittable Grant to River Smith's at 406 Ave QResolution No. 2022-R0325 Item No. 5.14 July 26, 2022 RESOLUTION WHEREAS, pursuant to Article IV, Section 5 of the Amended and Restated Bylaws of the Market Lubbock Economic Development Corporation (the "Corporation"), the City Council of the City of Lubbock (the "City Council"), as the Corporation's authorizing unit, has the authority to approve all programs and expenditures of the Corporation; and WHEREAS, the City Council finds that it is in the best interest of the public to approve the program or expenditure, as proposed to the City Council by the Corporation, as set forth in Exhibit "A" attached hereto and incorporated herein by reference; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Downtown Permittable Grant program or expenditure of the Corporation, in the amount set forth in Exhibit "A" attached hereto and incorporated herein by reference, to be provided to BPC Restaurant Group, LLC, dba River Smith's is hereby approved pursuant to Section 5 of the Amended and Restated Bylaws of the Corporation. Market Lubbock DT Permittable Grant -- River Smiths 6.30.22 July 26, 2022 Resolution No. 2022-RO325 RE 22-37 RESOLUTION APPROVING BPC RESTAURANT GROUP, LLC DBA RIVER SMITH'S DOWNTOWN PERMITTABLE GRANT - AT 406 AVENUE Q THE STATE OF TEXAS COUNTY OF LUBBOCK At a regular meeting of the Board of Directors of MARKET LUBBOCK ECONOMIC DEVELOPMENT CORPORATION, INC., a Texas nonprofit corporation (MLI), on Wednesday, June 29, 2022, held in conformity with the bylaws, after due notice as therein provided, a quorum being present and acting, the following resolution was unanimously adopted: WHEREAS, MLI presented to members of the Board the proposal of possible Economic Development Grant and Contract to BPC Restaurant Group. LLC, dba River Smith's at 406 Avenue Q. and is replacing the HVAC system of their building, which is located in the Downtown TIF. River Smith's began 46 years ago in a tiny A -frame on East Parkway Drive, and they shuffled locations for several years before landing at 4' Street and Avenue U. When Marsha Sharp Freeway came along, they were uprooted and moved to their current downtown location at 406 Avenue Q and have been there for over 22 years. The scope of permittable work will include replacing the HVAC system for $24,891 in expenses. The terms and conditions of such Economic Development Grant and Contract, other than the normal terms and conditions applicable to all such Economic Development Grant and Contracts by the Corporation, are described generally as follows, to wit: Grant BPC Restaurant Group a Downtown Permittable Grant for $2,489 at 406 Avenue Q. which is located in the Downtown TIF, once proof of payment has been submitted. WHEREAS, The Board of Directors of MLI finds that an Economic Development Grant and Contract offering the incentive for providing assistance for renovations to their property, meet and comply with the qualifications and purposes of the Corporation for the granting of such Economic Development Grants and Contracts. Upon Motion by Director, Mr. Walter Cathey, and Seconded by Director, Mr. James Conwright. IT WAS RESOLVED that MLI offer and, if accepted by Recipient, enter into an Economic Grant and Contract with BPC Restaurant Group. LLC. for improvements to the property at 406 Avenue Q. Lubbock. Texas. This Economic Development Grant and Contract will be on the normal terms and conditions of such Downtown Grant Program and Contract offered by MLI to existing businesses and business prospects and authorize the CEO to enter into and execute all documents related to the Economic Grant and Contract. Take them apart, wash the coils, and pick up the trash. Put them back together, check the electrical parts, and refrigerant charge. Two of the York condensers #1 and #3 need to be replaced. One has an outdoor coil leaking refrigerant and the other has a bad compressor. The new units will be set on legs to help keep them clean. Two blower motors are out and one control board. Replace the motors and install new capacitors. Clean the blower parts. When one of the motors burned up it also burned the neutral out of the control board. The front kitchen units are in very bad shape. The emergency drain pan is rotten and the coils are too. The coils are also stopped up. Replace the existing indoor equipment with Maytag air handlers. Install new sheetmetal return air duct plenums and install them where it is easy to remove for easy access to the indoor coil for cleaning.
