MOTION was made by Carpenter and seconded by Forrest
that the City Commission of Lubbock agree to accel
the pxvvisions contained in Pfidnute Order Number 38179 passed by the State.
Ughway Commission on May 25, 195 5 for the improvement by the Texan
Highway Department of the streets described below;
East Broadway .from Date Avenue to Zenith Avenue, widening and
resurfacing of pavement, a distance of approximately 1.3 miles;
VOTE 014 THE NOTION was as follows: Mayor .Tr4. and Commissioners Baker Car enter,
Forrest and Thomas voting Yea. none vo

WHEREAS, in LUBBOCK COUilaY on LOOP No. 230, the City of Lubbock has requested
assistance in the ening and resurfacing of pavement including incidental
items thereto on East Broadway from Date Avenue to Zenith Avenue, a distance of
approximately 1.3 miles; and
WHEREAS, an analysis of the requested work indicates that such widening and
resurfacing will materially add to traffic safety on this facility;
N071VI, THEREFORE, the State Highway Engineer is directed to tender the following
proposal to the City of Lubbock:
Provided the City will:
1. Construct continuous curb and gutter and provide for all utility adjust-
ments, storm sewers, etc., all as may be necessary for a complete project
with the exception of pavement widening and resurfacing,
2. Enter into agreements according to standard forms of the Highway Depart-
ment to indemnify the State against any and all liability or damage
growing out of such construction.
3. Assume for maintenance Loop 230 as now designated extending from U. S,
Highway 87 East to U. S. Highway 62 upon completion of the construotion
herein authorized.
The Texas Highway Department will provide for widening pavement and its support
and resurfacing from Date Avenue to Zenith Avenue, at an estimated cost of
47,000.00.
Upon acceptance.of this Order and fulfiLiffent of its conditions by the appropriate
officials of the City of Lubbock the State Highway Engineer is directed to proceed
in the most feasible and economical manner with construction. Upon completion of
construction the designation of Loop 230 shall be automatically canceled and this
section of highway returned to the City of Lubbock.
This minute shall become operative upon acceptance by the City of Lubbock and if
not accepted within 90 days hereof shall be automatically canceled.
