WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, have entered into a contract as empowered
and authorized by Art. 6673-b, ''Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State
Highway system, which has heretofore been designated as Loop 2.89 by the State
Highway Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation
of the City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in order
to make certain highway improvements in connection with'said "Loop 289"
situated in and adjacent to the City of Lubbock and to the end that this
purpose be accomplished, the necessity of which is hereby confirmed by the
City Commission of the City of Lubbock, it is necessary that fee simple title
to the land hereinafter described be acquired by the City of Lubbock in
fulfillment and satisfaction of its contractual obligations to the State of
Texas; and,
WHEREAS Virginia Russell Pack and Doris Olga Holmes
own or have some character interest in land needed for the location, construc-
tion and maintenance of said Loop 289, and the value and total damages to the
owners for the fee simple title to said land,have been appraised in the amount
j of $l 00 and the Commission finds said amount to be fair
and equitable; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COMKISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in
Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf
of the State of Texas for the purpose of opening, constructing and ma.intairfing
in conjunction with the State Highway Commission, said "Loop 289" as a
designated part of the State.Highway System, which land is more particularly
described as follows:
0.091 of one acre, being all of the following 0.463 of one acre tract,
EXCEPT however, 0.372 of one acre being a strip of land 30.0 feet in width,
lying adjacent to the East boundary line of Section 77, presently being in
the right of way of a public road. The 0.463 of one acre of land being out
of and a part of that certain 65 acre tract in Section 77, Block A, conveyed
to Virginia Russell Pack., etal by deed dated 20 3une'59, of record in
vol. 748, page 47, Deed Records of Lubbock County, Texas, which 0.463 of one
acre tract is more particularly descri.b.ed by metes and bounds as follows'.
BEGINNING at the northeast corner of said 65 acre tract, said point
being 2098.9 feet South of the Northeast corner of said. Section 77;
m THENCE S 0017' E:, 540.6 feet along the East boundary line of said
Section, 77, to the Southeast corner of said 65 acre tract;
THENCE S 89'40' W, 30.0 feet along the South boundary sine of said 65
acre tract;
THENCE N 0017' W, 374.6 feet along; a line parallel to and 30.0 feet West
of the East boupary line of said section;
THENCE in a 4orthwesterl.y direction along a circular curve to the left,
the center of the curve being S 89043' W, 215.0 feet from the beginning of
the curve, a distance of 189.6 feet, to a point in the North boundary line
of said 65 - cre tract;
THENCE N $9°40' E, 108.3 Feet along said North boundary line to the
place of beginning.
THAT the owners of said land be offered, through the Right of Way
Department, the amount appraised as the value and total damages for the fee
simple title and acquisition of said land for the purposes herein Mated,
for the use and benefit of the City of Lubbock and State of Texas, and
unless accepted forthwith the City Attorney is hereby authorized and instrue
ted to institute condemnation proceedings to acquire the fee simple title
to said land as hereinabove described for highway purposes.
