HomeMy WebLinkAboutResolution - 2018-R0240 - Park Land Conversion For Police Substation - 07/26/2018Resolution No. 2018-RO240 Item No. 7.1 July 26, 2018 RESOLUTION WHERELAS, the City of Lubbock, a home -rule municipal corporation, in the State of Texas, provides Police and Public Safety services to its citizens; and WHEREAS, the City of Lubbock has adopted a Community Policing philosophy based on a geographic policing model in order to serve a growing population; and WHEREAS, the City of Lubbock owns property bordered on the north by E. 19 1h Street, and the west by Martin Luther King Boulevard, called Lake #6 or Dunbar Historical Lake, located in East Lubbock (the "Property"); and WHEREAS, the City of Lubbock desires to build a Police Substation (the "Project") on a portion of the Property; and WHEREAS, there are no park facilities currently located on this portion of the Property; and WHEREAS, the Director of Parks and Recreation Department and the Chairman of the Parks and Recreation Board of the City of Lubbock have been notified of the Public Hearing; and WHEREAS, the City Council ofthe City of Lubbock, as the governing body of' the City of Lubbock, believes that it is in the best interest of the health, safety and welfare of the citizens of Lubbock to build the Project on a portion of the Property; and WHEREAS, the City Council ofthe City ot'Lubbock, as the governing body of the City of Lubbock, pursuant to Chapter 26 of thcTcxas Parks and Wildlife Code, desires to adopt this RE -SOLUTION changing the use of the Property to build the Project; NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City must increase its Police presence to provide Public Safety service in East Lubbock. SEXTION2. THAT. after hearing the testimony and evidence presented to the City Council of the City ol'l.ubboek, the City Council determines that there is no other feasible and prudent alternative to locating the Project on a portion of the Property. SECTION 3. THAT, after hearing the testimony and evidence presented to the City Council of the City ofLubbock, the City Council determines that building the Project on the northwest portion of the Property includes all reasonable planning to minimize harm to the Property. SECTION 4. THAT'the City Councilor the City of Lubbock, as the governing body of the City of Lubbock, has considered the clearly enunciated local preferences regarding changing the use of a portion of the Property to build the Project for the Lubbock Police Department. SECTION 5. THAT' the City Council of the City of Lubbock, as the governing body of the City of Lubbock, believes that it is in the best interest of the health, safety and welfare of the citizens of Lubbock to build the Project on a portion of the Property. SECTION 6. THAT on the 26" day of July. 2018, pursuant to Chapter 26 of the'fexas Parks and Wildlife Code, the City Council of the City of Lubbock held a public hearing in the council chambers to consider changing the use of a portion of the Property to that of the Project. SECTION 7. 'THAT, pursuant to § 26.002(c) of the Texas Parks and Wildlife Code, notification of this hearing was published in the newspaper of general circulation once a week for three consecutive weeks prior to the date of this hearing. SECTIONS. THAT, pursuant to § 26.002(a) of the Texas Parks and Wildlife Code. notice of this hearing was given to each person, organization, department, or agency that has supervision over the Property.
