THE POSSESSION OF INTOXICATING LIQUORS p R THE DRINKING OF SUCH INTOXICATING LIQUORS IN ANY PUBLIC PARK,. 23 !STATE OR MUNICIPAL, WITHIN THE CORPORATE LIMITS OF LUBBOCK,. 7-26-62 !TEXAS, TO BE A NUISANCE AND A MISDEMEANOR PUNISHABLE BY FINE NOT TO EXCEED $200. 00. ~ ,{g1 WHEREAS, there are constant complaints about drinking intoxicating liquors S ~q and the throwing of bott~es .. cans, and containers of all kinds in the, public parks, state and municipal, creating insanitary conditions within the corporate limits ~of the City of Lubbock, Texas; and, l WHEREAS, such use of the public parks within the corporate limits is unclean, insanitary, and obnoxious to the health and general welfare of the citizens of said City of Lubbock; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT loitering in any public park with intoxicating liquor on ~the person or the drinking of any intoxicating liquors in any public park or the 1throwing of bottles or other containers in such public parks or the spilling or !'pouring of any such intoxicating liquor on the ground or premises in said public Jlparks .. thereby causing flies, insects, and an insanitary condition, are hereby rc::;I:::.al::::c:~ unlawful for any person to consume any alcoholic jbeverage in any public park or for any person to possess any alcoholic beverage lin a,ny public park within the corporate limits of the City of Lubbock, Texas. SECTION 3. Any person violating any provision of this O rdinance shall be guilty of a misdemeanor and, upon conviction therefor, shall be punished by a fine not to exceed $200. 00. I SECTION 4. This Ordinance is severable and if any section of the same 1shall be declared void for any reason, this shall not affect any other section or part of said Ordinance but the same shall remain in full force and effect.
