HomeMy WebLinkAboutResolution - 2019-R0058 - Municipal Court - Texas Legislature - 02/25/2019Resolution No. 2019-R0058 Item No. 7.29 February 25, 2019 RESOLUTION WHEREAS, pursuant to Chapter 30, Subsection B of the Texas Government Code, the City of Lubbock, Texas has established the City of Lubbock Municipal Court of Record (the "Lubbock Court"); and WHEREAS, the Lubbock Court is subject to certain general provisions of Chapter 30 of the Texas Government Code relating to municipal courts of record that do not comport with desired court practices and procedures that are unique to the City of Lubbock; and WHEREAS, the majority of Texas cities that have established a municipal court of record have excepted certain requirements in the general provisions relating to municipal courts of record from their own specific enabling statutes for their respective courts; and WHEREAS, the City Council of the City of Lubbock desires that an amendment be passed by the Texas Legislature relating to the Lubbock Court excepting the Court from certain statutory regulations that conflict with the local conditions in the City of Lubbock; and WHEREAS, such legislation would only affect the Lubbock Court and would have no force or effect on any other municipal court of record in the State of Texas. NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby requests that the 86t' Legislature of the State of Texas pass legislation specific to the Lubbock Court in order to modify the municipal court of record statutes to comport with conditions and circumstances in the City of Lubbock. A copy of the proposed legislation is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of City Council.
