RESOLUTION
WHEREAS, on December 17, 2018, the City Council of the City of Lubbock passed Resolution
No. 2018-RO452 adopting the City of Lubbock City Council Policy and Procedure for Boards,
Commissions, and Committees (the "Council Policy"); and
WHEREAS, the City Council deems it to be in the best interest of the citizens of the City of
Lubbock to amend the Council Policy by amending Section XVIII to delegate authority to the City
Manager to determine the requirement for certain boards, commissions and committees to abide
by the terms of Chapter 511 of the Texas Government Code; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council does hereby amend the Council Policy to read as follows::
XVIII. TEXAS OPEN MEETINGS LAW:
It is the policy of the City of Lubbock to comply with all provisions of the Texas
Open Meetings Act (the "Act"). This includes Advisory Boards of the city, unless
exempted in this section. In an attempt to comply with this Act and to notify the
local media of all affected meetings, the Public Information Office will publish a
"Weekly Calendar of Events".
If the staff liaison and/or board members feel that an executive session is
necessary to discuss legal issues or land acquisition, the staff liaison should make
this request to the City Manager or the Acting City Manager.
The Audit and Investment Committee, insofar as it is not a governmental body
and is advisory only, and is thus not subject to the requirements established by the
Act, shall be exempt from the internal city policies established in this section.
The City Manager has the authority to except a particular board, commission or
committee from the requirements of the Act if:
(1) The board, committee, or commission is not otherwise subject to
the requirements of the Act; and
(2) The City Manager determines that such an exception is necessary
in order to best facilitate the duties and efforts of that board,
committee, or commission.
THAT this amendments shall be effective upon passage; and
THAT these amendments to the Council Policy are hereby incorporated into the Council Policy
and shall be included in reprints.
