AN ORDINANCE CREATING A WATER RESOURCE BOARD, DEFINING AND DESIGNATING THE TERM DF
OFFICE OF ITS MEMBERS PROVIDING FM APPOINTMENT OF ORIGINAL. MEMBERS OF SAID BOARD
AND THEIR SUCCESSORS,fVESTING SAID BOARD WITH POWER TO INVESTIGATE AND MAKE RECOMMEN-
DATIONS Tu THE CITY COMMISSION AS DIRECTED BY THEM, OF MATTERS CONNECTED WITH AND
INVOLVING NEEDED EXPANSION OF THE CITYIS WATER SYSTEM INCLUDING LOCATION AND ACQUISI•
TION OF ADDITIONAL WATER SUPPLY SOURCES FOR THE CITY OF LUt3BOCK,/AND PROVIDING FOR
REMOVAL OF MEMBERS OF SAID BOARD.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK,. TEXAS:
Section 1. There is hereby created and established a Plater Resource Board to be
composed of fifteen (15) members, each of whom shall be resident citizens of the Ci
of Lubbock, Texas, and said board shall be officially designated as the "hater
Resource Board" of the City of Lubbocky Texas, The members of said board shall be
appointed by the City Commission of the City of Lubbock, Texas and shall hold their
office for a term of five (5) years, except that the members first selected shall
hold office for terms of 1, 21 3, 4 and 5 years respectively, three (3) members to
hold terms for each of said periods, the term of each to be determined by lot, and
thereafter their successors shall hold office for five (5) years and until their su
cessors are appointed*
Section 2. Upon the death, resignation, removal or expiration of the term of
office of any of the members of said Water Resource Board, the City Commission shall
nominate'and appoint a successor as a member of said board who shall hold his member,
ship on said board for the unexpired term of the member he is appointed to succeed,
or for the period of five (5) years when the appointment is made due to the expira-
tion of a board members term, and further provided that in the event the best in-
terests of the City of Lubbock require the removal of any member of said board, re-
moval of such member shall be effected through appointment of such members successor
by unanimous vote of the City Commission.
Section 3. No salary or compensation of any sort shall be paid to the members of
said Water Resource Board for their services.
Section /., When the City Commission of the City of Lubbock has appointed fifteen
(15) persons to compose the Water Resource Board of the City of Lubbock, said board
shall, as soon thereafter as is practicable, meet and organize and shall appoint one
of its members as Chairman, and one of its members as Secretary, and it shall be the
duty of the Chairman to preside at all meetings of the Board, and the Secretary shall
keep a record of all the preceedings of said board, which shall upon the request of
the City Commission be delivered to it for its inspection and review.
Section 5. Any and all recommendations made by said board to the City Commission
shall be by the concurring vote of eight members of the Board, provided however, thi;
provision shall not exclude a minority recommendation which is hereby authorized to
be made in writing by less than a majority of the members of said board, and a major-
ity of the total membership of said board shall constitute a quorum for the trans-
action of all matters to be considered by said board.
Section 6. The Water Resource Board hereby created is and shall constitute an
advisory board to the City Commission of the City of Lubbock with power to hold hear
ings in Lubbock, consider and make recommendations to the City Commission in writing
from time to time on any and all matters pertaining to the enlargement of the City
of Lubbockzs water system and the extension thereof, and the location, securing,
development and acquisition of additional water supply sources for the City of Lubbo
Section 7* The following officers of the City of Lubbock shall be ex officio
members of said Board without voting privileges and shall act in an advisory capaci
to said board:
City Manager
City Engineer
The fact that there is an immediate need for study and consideration of matters
involving the extension of the Water supply system of the City of Lubbock and
securing additional sources of water supply for said system in behalf of public
healthy safety, and welfare creates an emergency and necessity for suspending all
rules that ordinances be read on several days and the said rules are hereby suspen-
ded and this ordinance shall become effective upon its first reading and passage*
AND IT IS SO ORDERED.
