THAT the resolution of the City Council of the City of Lubbock dated May !'$, 1954 providing for Workmen's Compensation Insurance BE and is ereby rep°ealcd. SECTION 2 THAT a program of Self-Inuurance covering all City of Lubbock Officials, Officers and Employees, BE and is hereby established. SECTION 3. THAT Rules for t' ,w Administering such Self-Insu.ranee. Program: sha11 be established by the City Manager, in accordance with kie laws of the State of 'Texas, with such Rules setting forth the procedures to be follovued in subinitting'- accident, claims; the processing of such claims and amount of benefits recoverable Eder such Program. SECTION 4. The SelfMInsurance Program shall be administered by the City a - Manager acting by and through the Director of Safety who shall be termed the "administrative officer' SECTION" 5. Notice of the determination of the City Council to adopt this Self -I ` urance Program shall be given by the Mayor of the City of Lubbock to the Industrial .Accident Board of Texas and to all employees of the City of Lubbock. SECTION 6. Should any section., paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 7, THAT the City Secretary is hereby authorized to cause publica- tion of the descriptive caption of this Ordinance as an alternative method provided y law. Clt6rney 2 «» CITY OF LUBBOCK MEMORANDUM TO: All Directors and Department Heads June 4, 1971 FROM: WRB SUBJECT: Workmen's Compensation Insurance Effective May 13, 1971, by Ordinance #6083 of the City Council, the City of Lubbock has initiated a self -insured program applicable to on-the-job injuries and resulting disability of all City employees. Benefits under this program will be in accordance with the provisions of the Texas Employer's Liability and Workmen's Compensation Insurance Law. The application and administration of this program will be handled by the Director of Safety in accordance with operating and procedural ruses promulgated from time to time by the City Manager and/or the City Council. The Workmen's Compensation Schedule, upon authorization and direction of the employee's Department Head, will be administered as follows: 1. Injury leave: full-time employees who have sustained an on-the-job injury will be entitled to full salary continuance for the duration of the incapacity not to exceed ninety working days. (Police and Fire Civil Ser- vice Personnel injury leave governed by State law.) Em- ployees electing to use injury leave will hold the City harmless of any liability related to such individual job - incurred injury. The Division Director, Department Head, and Director of Internal Safety will review each workmen's compensation case that extends for two or more weeks' duration at the end of each pay period. In exceptional cases, the Division Director, the Depart- ment Head, and the Director of Internal Safety may make a recommendation to the City Manager for review and ex- tension of the full salary continuance beyond the stated limit. Part-time employees who have sustained an on-the-job injury will be entitled to a partial salary continuance based on the agreed working time. If the•working schedule is variable or sporadic, the part-time employee will be paid on the basis of the average daily time worked during -the thirty -day period Immediately preceding the injury, or during the period act- ually worked, if less than thirty days. .. Partial or total and permanent disability, dismemberment, and accidental death will be administered in accordance with the laws of the State of Texas. The City of Lubbock will pay the entire cost of this program. We ask the complete cooperation of every City employee in order to insure the success of the plan. W. R. Blackwell City Manager
