RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and
on behalf of the City of Lubbock, Amendment No. 3 to Contract No. 13247 and all related
documents by and between the City of Lubbock and Lutheran Social Services of the South, to
provide utility assistance to qualified low-income persons and families through the
Comprehensive Energy Assistance Program administered by the Texas Department of Housing
and Community Affairs. Said Amendment is attached hereto and incorporated in this resolution
as if fully set forth herein and shall be included in the minutes of the City Council.

THIRD AMENDMENT TO COMPREHENSIVE ENERGY ASSISTANCE PROGRAM
AND COMMUNITY SERVICES BLOCK GRANT AGREEMENT
This Third (3`d) Amendment (the "Amendment") to the Comprehensive Energy Assistance
Program and Community Services Block Grant Agreement (the "Agreement") is made by and
between the City of Lubbock, a State of Texas home rule municipal corporation (the "City"), and
Lutheran Social Services of the South, Inc., a State of Texas non-profit organization (the
"Contractor"), (collectively the "Parties") acting by and through the Parties' representative
officers and officials, and is entered into by the Parties on June 14 , 2018 (the "Effective Date").
RECITALS
WHEREAS, the Contractor and the City executed the Agreement on February 23, 2017; and
WHEREAS, the City and the Contractor hereby desire to amend the Agreement; and
NOW THEREFORE, the City and the Contractor hereby amend the Agreement as follows:
AMENDMENT
Article 1. The language in Section II.A., on page 2 of the Agreement, entitled "General Overview
of Program," shall be replaced with the following language:
"The Contractor will use the CEAP funds awarded under this Contract to administer
the services contemplated under this Contract in the following manner:
CEAP Utility Assistance $749,081
CEAP Household Crisis $161,430
CEAP Program Services Cost $137,035
Total CEAP funds awarded under this Agreement $1,047,546"
Article 2. The language in Section II.B.I ., on page 2 of the Agreement, entitled "City
Responsibilities," shall be replaced with the following language:
"The City agrees to award the Contractor funding from the CEAP in an amount not
to exceed one million forty-seven thousand five hundred and forty-six dollars
($1,047,546) in return for the Contractor performing the services contemplated
under this Contract."
Article 3. The language in Section III., on page 3 of the Agreement, entitled "Time of
Performance," shall be replaced with the following language:
"This Contract shall commence January 1, 2017 and shall terminate June 30,
2018. The term of this Contract and the provisions herein may be extended on a
year to year basis during the five year roll-over cycle ending December 31, 2018,
provided funds are received from TDHCA, and providing the Contractor meets its
contractual obligations during the current funding year, subject to board approval
and the Mayor's signature."

Article 4. The language in Section IV., on page 4 of the Agreement, entitled "Budget," shall be
replaced with the following language:
"Program CEAP/CSBG Funds
CEAP Utility Assistance $749,081
CEAP Household Crisis $161,430
CEAP Program Services Cost $137.035
Total CEAP funds awarded under this Agreement $1,047,546"
Article 5. The language in Section V., on page 4 of the Agreement, entitled "Payment," shall be
replaced with the following language:
"The City will pay up to one million forty-seven thousand five hundred and forty-six
dollars ($1,047,546) to the Contractor based upon the receipt of request for funds and
project expense summary for the above -described project. The Contractor shall submit to
the City invoices for items purchased. The City shall determine the reasonableness of each
purchase. If a need is shown to exist, then City staff can release up to ten percent (10%) of
the funds to be used as start-up funding. The Contractor will then bill the City monthly for
expenses accrued during the month. By December 31, 2018, the Contractor will have
provided the City with proper documentation to show how all funds were expended,
including start-up costs."
Article 6. Upon execution by the Parties, this Amendment shall become effective on the Effective
Date, with the remainder of the Agreement remaining in full force and effect except as changed
herein.
