Home My WebLink AboutOrdinance - 8658 - Amending Zoning Ordinance No. 7084 - 08/23/1984u- August 23, 1984 Agenda Item #20 First Reading September 13, 1984 Agenda Item #12 Second Reading LJM:da ORDINANCE NO. 8658 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP CF THE CITY Of LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2485; CHANGE LOTS 468 THROUGH 487, DEPAUW-MCLARTY ADDITION, CITY Of WBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO R-2 ZONING DISTRICT; SUBJECT TO CONDITIONS; PROVIDING FOR A PENALTY AS PROVIDED FOR IN SECTION 1-4 Of THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been d.Jly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, morals, and general welfare to nake those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amend- nent to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as we11·as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock ~rning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, ard the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: f£ IT ORDAINED BY THE CITY COUNCIL Of THE CITY Of LUBBOCK: ZONE CASE NO. 2485 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: Change lots 468 through 487, OePauw-HcLarty Addition, City of Lubbock, Lubbock County, Texas, from R-1 to R-2 Zoning District located at 4600 Erskine Street and subject to conditions. SUBJECT TO THE FOLLOWING CONDITIONS: a. That it be limited to duplexes and that the duplexes be at least 75~ brick. b. That only one (1) driveway per pair of duplexes be allowed. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed two hundred cbllars as provided in Section 1-4 of the City Code. SECTION 3. THAT should any paragraph, sentence, clause, phrase or WJrd of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative rrethod provided by law. AND IT IS SO ORDERED.
