HomeMy WebLinkAboutOrdinance - 8281-1982 - Amending Ordinance No. 7084 - 02/11/1982ORDINANCE NO. 8281 AN ORDINANCE AMENDING ORDINANCE NO. 7084 OF THE CITY OF LUBBOCK, BEING THE ZONING CODE, SO AS TO MAKE THE FOLLOWING CHANGE; ZONE CASE NO. 2276; CHANGE LOT 4, BLOCK 1, WESTLAWN ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM AM SPECIAL USE TO AM SPECIAL USE (DR) ZONING DISTRICT; DESIGNATING A LANDMARK THEREON; INDENTIFYING CERTAIN EXTERIOR ARCHITECTURAL FEATURES OF THAT LANDMARK; PROVIDING FOR A PENALTY AS PROVIDED IN SECTION 1-5 OF THE CITY CODE; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the Gt:~flY-Jones-Hull Henry home located at 3407 19th is an example of Georgian Revival architecture originally constructed at 3501 19th in 1941, and, WHEREAS, the home has been associated with several prominent Lubbock citizens, including George W. Gr.iy, the original owner and Lubbock lumberman, Clifford B. Jones, rancher, president of the West Texas Chamber of Commerce, and President-emeritus of Texas Technological College, and Dr. 0. Brandon Hull, Lubbock physician and civic leader, and WHEREAS, the home was relocated in 1981 to prevent its demolition for parking, and WHEREAS, the home was relocated by Mayor Protem Alan Henry and his wife Sandy, who is the granddaughter of J. J. McLoen, who built the house for George W. Gray, and WHEREAS, the proposed change in zoning as hereinafter made has been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that it would be in the best interest of the public welfare to make the proposed change in zoning, and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 26 of Ordinance No. 7084, as well as notices provided by Article 1011f, Vernon's Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: . ' ZONE CASE NO. 2276 SECTION 1. THAT Lot 4, Block 1, Westlawn Addition, City of Lubbock, Lubbock County, Texas, BE and is hereby changed from zoning district, and declared to be a historic landmark district. SECTION 2. · THAT the principal residence located thereon BE and is hereby declared to be a historic landmark. SECTION 3. THAT any new buildings or structures within this historic landmark district shall be architecturally compatible with .the historic landmark structure therein, in terms of style, color, materials, texture and basic form as found in the following style: Georgian Revival, as described in the booklet, "Architecture in Lubbock: A Guide for Identificatio and Preservation," First Edition, 1979. SECITON 4. THAT the following BE and are hereby declared to be exterior architectural features, and as such shall be preserved in their present form: 1. the exterior walls and roof, 2. the location of the doors and windows, 3. the brick chimneys at each end of the house, 4. the balanced and symmetrical composition of the structure, 5. pedimented entryway, 6. classical portico with 4 Ionic columns, 2 engaged pilasters, plain entablature, and round window in gable end. 1. multi-light windows with wooden shutters and iron balconet on central window above entry, 8. wood surfaces shall be kept painted as needed for protection and appearance, with a color of paint similar to that used at present or contemporary and appropriate to its original use. SECTION 5. THAT incorporated by reference into this ordinance, and by attaching hereto, are photographs of the building as it presently appears. Said photographs shall be used to indicate the degree of alterat~on which has already occurred and the degree of preservation of the original structure. SECTION 6. lHAT Vi-olation :of any:·provision!f,,of this Ordinance shall-be.deemed a misdemeanor punif:Jhable by a fine not to exceed two hundred dollars as provide~ in Section 1-5.of -the City Code. SECTION 7. THAT,-should. any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinan.ce shall not be affected thereby. '' SECTION 8. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
