AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF
T:~E CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGES: ZONE CASE NO. 2129;
CHANGE LOT 5, BLOCK 13 AND BLOCKS 12, 16 AND 17, MORNING VIEW ADDITION INSTALl-
MENT NO. 2, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND A TRACT OF LAND OUT OF
THE SOUTHWEST QUARTER OF SECTION 3, BLOCK A, LUBBOCK COUNTY, TEXAS, INCLUDING
THE R. Z. ABELL ADDITION, CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM R-1 TO
M-1 ZONING DISTRICT: SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION
WHEREAS, the proposed changes in zoning districts as hereinafter made have
been duly presented to the Planning and Zoning Commission for its recommendatbn
which was received by the City Council and, after due consideration, the City
Council finds that making the proposed changes as hereinafter set out will be
in the public interest; and,
HHEREAS, all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 26 of Ordinance No. 7084, as well as
notices provided by Article lOllf, Vernon 1 s Annotated Civil Statutes, amended
in 1961, and notice was duly published in the Lubbock Morning Avalanche-Journal
more than fifteen (15) days prior to the date of the public hearing before the
City Council on such proposed amendment, and the public hearing according to
said notice was duly held in the City Counci I Room on the second floor ·of the
City Hall, Lubbock, Texas, at which time persons appeared in support of the
proposal; and, after said hearing, it was by the City Council determined that
it would be in the public interest, due to changed conditions, that the Zoning
Ordinance and the Zoning Map be amended in the manner hereinafter set forth in
the body of this Ordinance and this Ordinance having been introduced prior to
first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 2129
Change Lot 5, Block 13 and Blocks 12, 16 and 17, Morning
View Addition, Installment No. 2, City of Lubbock, Lubbock
County, Texas, from R-1 to M-1 zoning district.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That 2% landscaping be provided.
2. That a 43 foot setback be provided on highway U. S. 62,
Loop 289 and East 2nd Street.
3. That outside storage be screened by a so 1 id fence.
4. That no material stored outside be stacked higher than
the fence.

Change a tract of land out of the Southwest quarter of
Section 3, Block A, Lubbock County, Texas, from R-1 toM-1
zoning district. This property is further described by
metes and bounds as fol lows, and intentionally includes the
R.Z. Abell Addition, City of Lubbock, Lubbock County, Texas:
BEGINNING at a point which is 1170 feet North and
30 feet West of the Southeast corner of the South-
west quarter of Section 3, Block A, Lubbock County,
Texas;
THENCE t~est approximately 1220.1 feet to a point;
THENCE North 45°531 East approximately 1713,01 feet
to a point;
THENCE South 0°281 ~Jest approximately 1192-50 feet
to the PLACE OF BEGINNING;
Less a tract of land described in Zone Case No. 2116
and Ordinance No. 7418 of the City of Lubbock, Texas.
This property is further described by metes and bounds
as fol lows:
BEGINNING at a 1/211 square tube set as the Southeast
corner of this tract and in the East line of the
Southwest quarter of said section, from said tube
the Southeast corner of the Southwest quarter bears
South 0°081 West a distance of 1650 feet;
THENCE South 89°291 3011 West a distance of 753.30
feet toa 1/211 square tube set at the Southwest corner
of this tract in the Southeast right-of-way l ineof
the Idalou Highway;
TliENCE North 45°59 1 East along said right-of-way
line, a distance of 387.80 feet to a 1/211 square
tube set as the Northwest corner of this tract;
THENCE North 89°291 3011 East along the South line
of a tract recorded in Volume 356, Page 331 of the
Lubbock County Deed Records, a distance of 265.30
feet to a 1/211 rod set as the Southeast corner of
said recorded tract;
THEM CE North 45°591 East along the East l i ne of said
recorded tract, a distance of 90 feet to a 1/211 square
tube set as the [fortheast corner of said recorded tract;
THENCE North 89°29 1 3011 East a distance of 145. 14 feet
to a l/211 square tube set in the East I ine of the
Southwest quarter of said Section, for the Northeast
corner of this tract;
THEl~CE South 0°081 ~Jest along the East 1 ine of the
Southwest quarter of said section, at 6.45 feet past
a 3/411 rod set in the South line of 1st Street as
recorded by Morning View Addition, Installment #2,
continuing for a total distance of 328.95 feet to
the PLACE OF BEGINNING.

SUBJECT TO THE FOLLOWING CONDITIONS:

SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and oarcels of land described in Section l hereof
shall be changed to the zoning district indicated and the Official Map is
amended in accordance herewith.
SECTION 3. THAT any person, firm or corporation owning or operating the
subject property failing to comply with the conditions imposed by Section I
hereof shall be guilty of a misdemeanor and upon conviction thereof, shall be
subject to a fine not to exceed TWO HUNDRED DOLLARS and each and every day 1s
violation thereof shall constitute a separate and distinct offense.
The failure of any corporation owning or operating the subject property
to comply with any of the conditions imposed by Section l hereof shall render
the President, Vice-President, General Manager, Local Manager and Local Agent
liable to the penalty prescribed in this section.
SECTION 4. THAT should any section, paragraph, sentence, clause, phrase
or word of this Ordinance be declared unconstitutional or invalid for any
reason, the remainder of this Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary is hereby authorized to cause publ i-
cation of the descriptive caption of this Ordinance as an alternative method
provided by law. AND IT IS SO ORDERED.
