KJ:sw ORDINANCE NO. 6040 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LUBBOCK APPROVING THE URBAN RENEWAL PLAN AND THE FEASIBILITY OF RELOCATION FOR PROJECT NO. TEX. R-138(C). WHEREAS, the City Council of the City of Lubbock (herein called the iraoverning Body11) has heretofore certified by Resolution dated June 8, 1970, the area hereinafter described to be an urban area in need of redevelopment or rehabilitation as a result of a catastrophe which the President has deter- mined to be a major disaster; and, WHEREAS, under the provisions of Title I of the Housing Act of 1949, as amended, the Secretary of Housing and Urban Development is authorized to provide financial assistance to a Local Public Agency for the undertaking and carrying out of an urban renewal project in an urban area which the gov- erning body of the locality certifies and the Secretary finds is in need of re- development or rehabilitation as a result of a catastrophe which the Presi- dent has determined to be a major disaster; and, WHEREAS, it is provided in such Act that contracts for financial aid thereunder shall require that the Urban Renewal Plan for the respective pro- ject area be approved by the governing body of the locality in which the pro- ject is situated and that such approval include findings by the governing body that: (1) the financial aid to be provided in the contract is necessary to en- able the project to be undertaken in accordance with the Ui:-ban Renewal Plan (2) the Urban Renewal Plan will afford maximum opportunity. consistent with the sound needs of the locality as a whole, for the rehabilitation or re- development of the locality as a whole, for the rehabilitation or redevelop- ment of the urban renewal area by private enterprise; and (3) the Urban Re- newal Plan gives due consideration to the provision of adequate park and re- creational areas and facilities, as may be desirable for neighborhood improve- ment, with special consideration for the health, safety, and welfare of child- ren residing in the general vicinity of the site covered by the Plan; and, WHEREAS, the Urban Renewal Agency of the City of Lubbock (herein called the 11Local Public Agency") has entered into a planning contract for financial assistance under such Act with the United States of America, acting by and through the Secretary of Housing and Urban Development, pursuant to which Federal funds were provided for the urban renewal project (herein- after called the "Project") identified as 11Memorial Center Complex11 and encompassing the area bounded by Ave. K, 4th Street, Ave. Q and 10th Street in the City of Lubbock, State of Texas (hereinafter called the rrLocal- ityir); and, ·----· WHEREAS, the Local Public Agency has applied for additional fi- nancial assistance under such Act and proposes to enter into an additional contract or contracts with the Department of Housing and Urban Develop- ment for the undertaking of and for making available additional financial assistance for the Project; and, WHEREAS, the Local Public Agency has made detailed studies of the location, physical condition of structures, land use. environmental in- fluences, and social, cultrual, and economic conditions of the Project area and has determined that the area is a slum and blighted area and that it is detrimental and a menance to the safety. health, and welfare of the inhabi- tants and users thereof and of the Locality at large, because of blighted resi dential conditions and blighted commercial and industrial facilities as a re- s ult of natural deterioration and being further complicated by a tornado whicl virtually destroyed the economic base of this area, and members of this Governing Body have been fully apprised by the Local Public Agency and are aware of these facts and conditions; and, WHEREAS, there has been prepared and referred to the Governing Body for review and approval an Urban Renewal Plan for the Project area, dated February 25, 1971, and consisting of 18 pages and 4 exhibits, suppor- ted by the following supplementary material, data, and recommendations, which mate.rial, data and recommendations are not a part of the Urban Re- newal Plan: Part I and Part II of the Application fot' Loan and Grant, in- cluding Maps SDI through SD XII, Land Use and Marketability Study by Home" Akin, and Transient Housing Study by Homer Akin; and, WHEREAS, the Urban Renewal Plan has been approved by the Gov- erning Body of the Local Public Agency, as evidenced by the copy of said Body's duly certified resolution approving the Urban Renewal Plan, which is attached thereto; and, WHEREAS, th~ Urban Renewal Plan for the Project area prescribes certain land uses for the Project area and will require, among other things. changes in zoning, the vacating and removal of streets, alleys, and other public ways, the establishment of new street patterns, the location and re- location of sewer and water mains and other public facilities, and other public action; and, WHEREAS, the Governing Body of the Local Public Agency has causecl to be made a competent independent analysis of the local supply of hotel and other transient housing; and, - 2 - WHEREAS, the Local Public Agency has prepared and submitted proposals for the encouragement, to the maximum extent feasible, of the provision of dwellings suitable for the needs of individuals and families dis- placed by the catastrophe or by renewal activities in accordance with the Urban Renewal Plan; and, WHEREAS, there have also been presented to the Governing Body information and data respecting the relocation program which has been pre- pared by the Local Public Agency as a result of studies, surveys, and in- spections in the Project area and the assembling and analysis of the date and information obtained from such studies, surveys, and inspections; and, WHEREAS, the members of the Governing Body have general know- ledge of the conditions prevailing in the Project area and of the availability of proper housing in the Locality for the relocation of individuals and familie ~ displaced by the catastrophe or by renewal activifies in the Project area and, in the light of such knowledge of local housing conditions, have carefully con sidered and reviewed such relocation program; and, WHEREAS, if,is'necessary that the Governing Body take appropriate official action respecting the proposals for relocation and the Urban Renewal Plan for the Project, in conformity with the contract for financial assistance between the Local Public Agency and the United States of America, acting by and through the Secretary of Housing and Urban Development; and~ WHEREAS, the Governing Body is cognizant of the conditions that are imposed in the undertaking and carrying out of urban renewal projects with Federal financial assistance under Title I, including those prohibiting discrimination because of race, color, creed, or national origin; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT it is hereby found and determined that the Projec1 is a slum and blighted area and qualifies as an eligible Project area under Article 1269, L-3, Vernon's Annotated Civil Statutes, Texas Urban Renewal Law. SECTION 2. T:Hi\T the Urban Renewal Plan for the Project, having been duly reviewed and considered, is hereby approved, and the City Secre- tary-Treasurer be and is hereby directed to file said copy of the Urban Re- newal Plan with the minutes of this meeting. - 3 - --r r SECTION 3. THAT the acquisition of real property in the Urban Renewal area in furtherance of the urban renewal plan is hereby approved. SECTION 4. THAT it is hereby found and determined that the ob- jectives of the Urban Renewal Plan cannot be achieved through more extensiv~ rehabilitation of the Project area. It is also hereby found and determined that in the private re-use and redevelopment "slum clearance and redevelop- ment section" that the rehabilitation of such section without clearance would be impractical, infeasible and ineffective, based upon its finding that at least fifty per cent (50%) of the structures in such section are dilapidated beyond the point of feasible rehabilitation and that there exist other blighting characteristics, such as overcrowding of structures on the land, mixed uses of structures, and deficiencies in recreational and community facilities. SECTION 5. THAT it is hereby found and determined that the finan- cial aid provided and to be provided pursuant to the contract for Federal finaicial assistance pertain1.ng to the Project is necessary to enable the Pro- ject to be undertaken in accordance with the Urb'an Renewal Plan for the . Project area. SECTION 6. THAT it is hereby found and determined that the Urban Renewal Plan for the Urban Renewal Area will afford maximum opportunity, consistent with the sound needs of the Locality as a whole, for the Urban Renewal of the Area by private enterprise. SECTION 7. THAT it is hereby found and determined, as a result of a competent independent analysis of the local supply of transient housing, that there exists in the area a need for additional units of such housing. SECTION 8. THAT it is hereby found and determined that the pro- posals for the encouragement, to the· maximum extent feasible, of the pro- vision of dwellings suitable for the needs of individuals and families displace~ by the catastrophe or by renewal activities are feasible and can be reasonabl~ and timely effected to permit the proper prosecution and eompletion of the Project. SECTION 9. THAT it is hereby found and determined that the Urban Renewal Plan gives due consideration to the provision of adequate park and recreational areas and facilities, as may be desirable for neighborhood im- provement, with special consideration for the health, safety, and welfare of children residing in the general vicinity of the site covered by the Plan. -4 - .,,,-.,. -· SECTION 10. THAT, in order to implement and facilitate the ef- fectuation of the Urban Renewal Plan hereby approved, it is found and deter- mined that certain official action must be taken by this Body with reference, among other things, to chapges in zoning, the vacating and removal of street alleys, and other public ways, the establishment of new street patterns, the location and relocation of sewer and water /mains and other public facilities, and other public action, and, accordingly, 1this Body hereby (a) pledges its rooperation in helping to carry out the Urbah Renewal Plan; (b) requests the various officials, departments, boards, atj.d agencies of the Locality having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner con- sistent with the Urban Renewal Plan; and (b) stands ready to consider and tak appropriate action upon proposals and measures designed to effectuate the Urban Renewal Plan. SECTION 11. THAT additional finil.ncial assistance under the pro- visions of Title I of the Housing Act of 1949, as amended, is necessary to en able the land in the Project area to be renbwed in accordance with the Urban Renewal Plan for the Project area, and, accordingly, the filing by the Local Public Agency of an application or applicaHons for such financial assistance under Title I is hereby approved.
