Ba Verno~1 s Annotated Penal Code, finds that certain prima facie speed limits on certain highwajys are different._ from what is reasonable or safe and should be altered and the immedlfat' preservation of public health and safety require s immediate alteration of said prim facie speed limits as hereafter set forth~ which creates an emergency:~ NOW THER - FORE, BE IT ORDAINED BY THE CIT Y COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established~ by Article 827a. Sec. 8:. Subse ction l(b}• Vernonts Annotated Penal Code is altered and changed for all vehicles to thirty-five (35) miles per hour on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, to- wit: On the North side of 4th Stre et (U. s. Highway 82, beginning 1, 056 feet East of College Avenue and' extending West for 0. 450 miles. SECTION 2. The prima facie speed limit established, by Article 827a, Sec. 811 Subsection I(b},, Vernon1 s Annotated Penal Code is altered and changed for all vehicles to forty (4))} miles per hour on the following designated highway s or street n the corporate limits of the City of Lubbock, Lubbock County6 Texas, to-wit: On the North side of 4th Str.eet {U. S. Highway 82), beginning 0. 250 miles West of College Avenue and extending West for 0. 308 miles. On the Northwest side of Texas Tech Freeway (U• S. Vernon1s Annotated Penal Code is altered and changed for all vehicles to sixty (60) miles per hour day and fifty-five {55) miles per hour night .. on the following designated highway or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the Northwest side of Brownfield Highway (U. S. Highway 62.}, for Southwest bound traffic, beginning 1. 300 mile s Southwest of the inter- section of Slide Road and extending Southwest to the pre sent city limits. On the Southeast side of Brownfield. Highway (U. S. Highway 6Z.)., for Northeast bound traffic, beginning at the present city limits and extending Northeast 1. 010 miles. SECTION 6. The City Manager is authorized and directed to cause the placin of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 7. Any per son, firm or corporation violating the prima facie speed limit established b y this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLLARS ($2.00. 00) and for subsequent violations within 1one year thereafter shall be prosecuted as prescribed for such violations by Sec. 1 of Article 82.7a,. Vernon's Annotated Penal Code. SECTION 8. The City Secretary is authorized and directed to cause the pub- lication of the de s c ri pti ve caption of this Ordinance to get her with the penalty pro- vision as an alternative method of publication as provided by law. SECTION 9. That all ordinances or parts of ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. \. _ ... SECTION 10. All highways or streets not specifically set forth in the pre- ceeding sections hereof shall not be affected by the provisions hereof• and this or- inance shall be cumulative of all other prima facie speed limit ordinances except hose with which it specifically conflicts. SECTION 1.1. Should any section, paragrap~ sentence, clause~ phrase or ord of this ordinance be declared unconstitutional or invalid for any reason. the emainder of this ordinance shall not be affected thereby. SECTION 12.
