No. 458, 34th Street, the following described property has not provided the necessary right-ofpway. The east 215 feet of the west 495 feet of Lot 1, Block 3, Alta VistaACres Addition. Robinson appeared before the City Commission and protested the alley paving abutting the East one-half of Lots 10, 9 and g. Block 10, Overton Addition to the City of Lubbock. It was found by the City Commission that the paving of the alley abutting this property was instituted by commercial property owners on Avenue 'r '" to handle heavy commercial traffic in the alley, . and Mr.- Robinsont s propertq was, found to be residential. Therefore it was ruled by the City Commis— sion that`such'assessment contImplated'by this ordinance against East one-half of Lots ,, 9 and 8lock 10- Overton Addition, would not especially benefit said Lots _ut, B ting property, therefore, <no assessment shall be made against said East one—half of Lois 10, 9 and 8, Block '10, Overton Addition to the City of Lubbock,, Texas, and the City Engineer is hereby directed to correct; his assessment roll consistent with this finding. y This being the date set for hearing in regard to paving various and sundry residential -city streets and one alley'the contract for said paving having been let to Kerr and Middleton under General Work Order Number 835 of the City of Lubbock Texas, said hearing was held, Approximately fifty (50) persons appeared for the hearing and the following objections were made to the proposed paving,; Paving.on,37th Street, fro*.Avenue "A" to Avenue"E" was protested by Mr, W. A. Keelin, Mr. R. J. Maloney and Mr.'W. D'�, Dye, by reason of the fact that their houses from on 38th Street and the property extends thru to 37th Street and they would prefer to spend this rudney for paving the street in front of their residences instead of the vacant lots to the North of their property. Mr.`H. F. Sidwell appeared protesting the paving'of 37th Street from Louisville Avenue to Knoxville Avenue. Mr. R. A. Sowder, representingMr. M. 0. Owens,, pro. tested the paving of Avenue L ffom 34th Street to 30th'Street, Mrs, Alma Andrews,, nee Alma Lwellen, appeared in protest of the paving on 45th Street from Avenue "Ir", to Avenue "HIt. Mrs. J. E. Bain appeared in protest of the paving of dtica Avenue from 19th Street to 15th Street, form Protest was also received in letter/from 0. B. Ratliff,, protesting paving of Utica Avenue from 15th Street to 19th Street,, Mrs. Susie Poarch Ogle protested the pavipg of,' Sa1eni Avenue from 34th 'Street`to33rd Street Letter .;of' protest, dated January '15, l954, was received from Mrs. Emilie Nblte, protesting the paving of 45th Street from Avenue "H" to Avenue "L", All of the above protests were fully 'consid eyed by the City; Commission and it was found that none of the above 'mentioned `property owners:protesting the paving of the streets antained in this paving project stated- that 'the" assessments were in excess of the benefits which`would.be-derived from the'street'paving, therefore, all of the above protests and objections were overruled Mr. James R. Robinson appeared before the City Commission and protested the alley paving abutting' the East one-half of Lots 10, 9 and 8, Block 10, Overton Addition to the City of Lubbock. It was found by the City Commission that the paving of the alley; abutting this property was instituted by commercial property owners on Avenue "Q" to handle heady commercial traffic in the alley., and Mr. Robinsonts property was found to be- residential.'
