HomeMy WebLinkAboutResolution - 2018-R0082 - N50SQ, LLC - 02/22/2018Resolution No. 2018-R0082 Item No. 6.12 February 22, 2018 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, an Amendment to that certain Lease Agreement dated March 23rd, 2017, by and between the City of Lubbock and N50SQ, LLC, and related documents. Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. POPE, MAYOR City Attorney ccdocs/RES.Amendment to Lease N50SQ, LLC 01.30.2018 Resolution No. 2018-R0082 STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § AMENDMENT TO LEASE AGREEMENT This Agreement is entered into by the CITY OF LUBBOCK (referred to herein as "Lessor"), a Home Rule Municipality of Lubbock County, Texas, and N50SQ, LLC (referred to herein as "Lessee"). WITNESSETH: WHEREAS, Lessor and Lessee executed a Lease Agreement on the 23rd day of March, 2017, in which Lessee was granted the privilege of leasing 47,950 sq. ft. of land to build a hangar for their personal aircraft; and WHEREAS, Lessee desires to lease additional land of 4,052.75 sq. feet for customer parking, NOW THEREFORE, Lessor and Lessee agree as follows: I. Article One, 1.01 Leased Premises, is amended by adding the following sentence: "Land for customer parking — 4,052.75 square feet" The additional leased land is described in Exhibit "A-1 ". II. Article Three, 3.01 Rentals, A. Ground Rental, is amended by adding: "4. Land rental for customer parking for 4,052.75 sq. ft. at $.1799 per sq. ft. per year is $729.09 annually; $60.76 monthly."
