RESOLUTION
WHEREAS, pursuant to Article IV, Section 5 of the Amended and Restated Bylaws of the
Market Lubbock Economic Development Corporation (the "Corporation"), the City Council
of the City of Lubbock (the "City Council"), as the Corporation's authorizing unit, has the
authority to approve all programs and expenditures of the Corporation; and
WHEREAS, the City Council finds that it is in the best interest of the public to approve the
program or expenditure, as proposed to the City Council by the Corporation, as set forth in
Exhibit "A" attached hereto and incorporated herein by reference; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the program or expenditure of the Corporation, in the amount set forth in Exhibit
"A" attached hereto and incorporated herein by reference, to be provided to Pat Kelly
Properties, Inc. for 1310 Broadway, is hereby approved pursuant to Section 5 of the
Amended and Restated Bylaws of the Corporation.

Pat Kelly Properties, Inc., owner of multiple downtown properties, is renovating the interior of their
building at 1310 Broadway, located within the Downtown TIF. The scope of work will include updating
electrical wiring, updating two restrooms to current ADA code, replacing water heaters and HVAC
system, demolition of floors, ceilings and walls and replacing door glass totaling $72,238 in expenses.
The MLI Board is being asked to consider a Downtown Permittable Grant for Pat Kelly Properties, Inc.
totaling $7,224 at 1310 Broadway.

WE ARE PLEASED TO PROPOSE THE FOLLOWING:
Furnish and install one 7.5 ton R-410A air conditioning condensing unit to replace
existing. Due to the age of the evaporator coil, it will not withstand the pressure of the
R-410A refrigerant, therefore must be replaced as well. It will be replaced with two 5
ton R-410A evaporator coils with refrigerant piping manifold. Furnish and install two 5
ton drive/135K BTU natural gas furnaces with twinning kit to replace existing. Furnish
and install digital programmable thermostat.
TOTAL INVESMENT: $1.3,663.00
This proposal includes no tax.
This proposal includes all applicable crane fees.
This proposal. includes applicable City of Lubbock permits.
This proposal includes all applicable labor and material for the above install ation(s),
any additions or changes may be subject to extra cost.
Condenser and coils have a one (1) year manufacturer's parts warranty.

At a regular meeting of the Board of Directors of MARKET LUBBOCK ECONOMIC
DEVELOPMENT CORPORATION, INC., a Texas nonprofit corporation (MLI), on Wednesday,
January 24, 2018, held in conformity with the bylaws, after due notice as therein provided, a
quorum being present and acting, the following resolution was unanimously adopted:
WHEREAS, MLI presented to members of the Board the proposal of a possible Economic
Development Grant and Contract (Permittable and Fagade) to Pat Kelly Properties, Inc., at 1310
Broadway, Lubbock, Texas. The terms and conditions of such Economic Development Grant and
Contract, other than the normal terms and conditions applicable to all such Economic Development
Grant and Contracts by the Corporation, are described generally as follows, to wit:
Grant Pat Kelly Properties, Inc., a Permittable Grant in the amount of $7,224 to update
electric wiring, updating two restrooms to current ADA code, replace water heaters and HVAC
system, demolition of floors, ceiling and walls and replacing door glass with total expenses of
$72,238, and a Fagade Grant in the amount of $25,000 towards the work to update the facade of
approximately 4,000 square feet, replacing windows and exterior doors and removing an awning
with total of $52,500 in expenses.
WHEREAS, The Board of Directors of MLI finds that an Economic Development Grant
and Contract offering the incentive for providing assistance to renovate and update the facility
meet and comply with the qualifications and purposes of the Corporation for the granting of such
Economic Development Grants and Contracts.
Upon Motion by Director, Mr. Calvin Davis, and Seconded by director, Mr. Barry Orr,
it was approved,
IT WAS RESOLVED that MLI offer and, if accepted by Recipient, enter into an Economic
Grant and Contract with Pat Kelly Properties, Inc., at 1310 Broadway, Lubbock, Texas. This
Economic Development Grant and Contact will be on the normal terms and conditions of such
Downtown Permittable Grant and Fagade Grant Program and Contract offered by MLI to existing
businesses and business prospects and authorize the CEO to enter into and negotiate Performance
Agreement.
