HomeMy WebLinkAboutOrdinance - 2014-O0105 - Raider Ranch Closure - 10/17/2014First Reading July 24, 2014 Item No. 6.6 ORDINANCE N0. 2014-00105 Second Reading August 28, 2014 Item No. 5.4 AN ORDINANCE ABANDONING AND CLOSING AN ACCESS EASEMENT, UNDERGROUND UTILITY EASEMENT AND DRAINAGE EASEMENT (COLLECTIVELY, THE "EASEMENTS"), LOCATED IN TRACT C, RAIDER RANCH, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AS SHOWN ON THE CERTAIN PLAT THEREOF FILED OF RECORD UNDER COUNTY CLERK NO. 2008020931, OFFICIAL PUBLIC RECORDS, LUBBOCK COUNTY, TEXAS, INSOFAR AND ONLY INSOFAR AS THE EASEMENTS COVER AND ENCUMBER THAT CERTAIN TRACT OF LAND DESCRIBED IN EXHIBIT "A", ATTACHED HERETO (THE "ABANDONMENT TRACT"); DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID PARTIAL ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the Easements, INSOFAR AND ONLY INSOFAR as the Easements cover and encumber the Abandonment Tract, are no longer needed for easement purposes and for public use; and it would be in the public interest to partially close, vacate and abandon the same for easement purposes and for public use, and it would be in the public interest to partially close, vacate and abandon the same, all as expressly provided herein; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Easements, INSOFAR AND ONLY INSOFAR as the !nts cover and encumber the Abandonment Tract, BE and the same are hereby vacated and abandoned for easement purposes and for public use. SECTION 2. THAT the City hereby expressly retains and reserves, and this dinance shall not affect, any right, title or interest that the City may own, occupy, hold possess under or pursuant to the Easements, INSOFAR as said Easements may cover J encumber lands other than the Abandonment Tract, and said Easements, INSOFAR they may cover and encumber lands other than the Abandonment Tract, shall remain lid and subsisting and in full force and affect in accordance with the terms thereof. SECTION 3. THAT the City Engineer is hereby authorized and directed to mark official maps of the City of Lubbock to reflect said partial abandonment and closing, wing the number of this Ordinance and the date of its final passage. SECTION 4. THAT should any section, paragraph, sentence, phrase, clause or of this Ordinance be declared unconstitutional or invalid for any reason, the ader of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary of the City of Lubbock is hereby thorized and directed to cause publication of the descriptive caption of this Ordinance an alternative method provided by law.
