RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and
on behalf of the City of Lubbock, seven City of Lubbock Health Department — Substance Use
Service Assistance Network Community Health Workers Program Memorandums of
Understanding (MOUs), by and between the City of Lubbock and Cenikor Foundation,
Oxford House, Plainview Serenity, Inc., Salvation Army, Grace Campus, Grace Manor, and
Lubbock Lighthouse, and all related documents. Said MOUs are attached hereto and
incorporated in this resolution as if fully set forth herein and shall be included in the minutes
of the City Council.

11. STATEMENT OF SERVICES TO BE PERFORMED:
The parties hereto, agree by execution of this Memorandum of Understanding to participate
in an integrated collaborative effort to meet the specific needs of the priority population,
including serving as an essential link between prevention, intervention and treatment
services, information and resources within Region 1. Partners of the Substance Use Service
Assistance Network will specifically work to increase linkage and retention in substance use,
mental health and medical services for residents living with substance use disorders.
We the undersigned have agreed that we shall work together through a cooperative effort.
This collaboration is not an offer of employment and does not include any additional
funding.
III. OBLIGATIONS OF THE CITY OF LUBBOCK HEALTH DEPARTMENT:
a. Address behavioral health disparities in the program service area.
b. Increase opportunities for substance users, including opioid users, to reduce harms
related to substance use.
c. Increase retention in substance use and mental health services.
d. Help individuals address medical needs.
e. Help Individuals who desire change to build a foundation for their recovery.
IV. OBLIGATIONS OF PARTNERING AGENCIES:
a. Referring individuals who use substances, including but not limited to, adults and youth,
populations who are marginalized or stigmatized, experiencing housing instability or
homelessness, inject substances, live with or at risk of Hepatitis C (HCV) or Human
Immunodeficiency Virus (HIV), in need of medical and/or mental health services,
experience greater barriers to entering treatment or recovery services, and those
seeking to enhance their recovery capital and maintain their recovery from substance
use disorders to the Substance Use Service Assistance Network (S.U.S.A.N.) Program.
b. Invite the S.U.S.A.N. Program to perform outreach during events or at the agencies
facility to inform clients of available services and supports.
c. Include the S.U.S.A.N. Program in client long-term recovery and discharge plans to allow
for additional case management and support.
d. Meet with S.U.S.A.N. case workers regularly to discuss available services for clients to
ensure that resources are used in an effective and sustainable manner and to confirm
that there is not a duplication of services among partnering agencies.
V. TERM OF AGREEMENT:
This agreement is to begin September 1, 2021 and shall terminate August 31, 2022. This
MOU may be extended for successive twelve (12) month terms by written agreement of the
parties. This MOU may be terminated by any party upon 30 days written notice to the other
party.
THE UNDERSIGNED AGENCIES do hereby certify that, (1) the services specified above are necessary and
essential for activities that are properly within the statutory functions and programs of the effected
agencies and (2) the proposed arrangements serve the interest of efficient and economical
administration.
THE CITY OF LUBBOCK HEALTH DEPARTMENT AND IT'S AGENTS further certify that it has the authority
to enter into this agreement for the above services under the provisions of Chapter 534 of the Texas
Health & Safety Code Ann., as amended.
Non -Arbitration: The City reserves the right to exercise any right or remedy available to it by law,
contract, equity, or otherwise, including without limitation, the right to seek any and all forms of relief in
a court of competent jurisdiction. Further, the City shall not be subject to any arbitration process prior
to exercising its unrestricted right to seek judicial remedy. The remedies set forth herein are cumulative
and not exclusive, and may be exercised concurrently. To the extent of any conflict between this
provision and another provision in, or related to, this document, this provision shall control.
Nonappropriation: All funds for payment by the City under this contract are subject to the availability of
an annual appropriation for this purpose by the City. In the event of nonappropriation of funds by the
City Council of the City of Lubbock for the goods or services provided under the contract, the City will
terminate the contract, without termination charge or other liability, on the last day of the then -current
fiscal year or when the appropriation made for the then -current year for the goods or services covered
by this contract is spent, whichever event occurs first. If at any time funds are not appropriated for the
continuance of this contract, cancellation shall be accepted by the Seller on thirty (30) days prior written
notice, but failure to give such notice shall be of no effect and the City shall not be obligated under this
contract beyond the date of termination.
SB252: SB 252 prohibits the City from entering into a contract with a vendor that is identified by The
Comptroller as a company known to have contracts with or provide supplies or service with Iran, Sudan
or a foreign terrorist organization.
HB 89: The Contractor warrants that it complies with Chapter 2270, Subtitle F, Title 10 of the Texas
Government Code by verifying that:
(1) The Contractor does not boycott Israel; and
(2) The Contractor will not boycott Israel during the term of the Agreement.

I. AGENCIES:

It. STATEMENT OF SERVICES TO BE PERFORMED:
The parties hereto, agree by execution of this Memorandum of Understanding to participate
in an integrated collaborative effort to meet the specific needs of the priority population,
including serving as an essential link between prevention, intervention and treatment
services, information and resources within Region 1. Partners of the Substance Use Service
Assistance Network will specifically work to increase linkage and retention in substance use,
mental health and medical services for residents living with substance use disorders.
We the undersigned have agreed that we shall work together through a cooperative effort.
This collaboration is not an offer of employment and does not include any additional
funding.
III. OBLIGATIONS OF THE CITY OF LUBBOCK HEALTH DEPARTMENT:
a. Address behavioral health disparities in the program service area.
b. Increase opportunities for substance users, including opioid users, to reduce harms
related to substance use.
c. Increase retention in substance use and mental health services.
d. Help individuals address medical needs.
e. Help Individuals who desire change to build a foundation for their recovery.
IV. OBLIGATIONS OF PARTNERING AGENCIES:
a. Referring individuals who use substances, including but not limited to, adults and youth,
populations who are marginalized or stigmatized, experiencing housing instability or
homelessness, inject substances, live with or at risk of Hepatitis C (HCV) or Human
Immunodeficiency Virus (HIV), in need of medical and/or mental health services,
experience greater barriers to entering treatment or recovery services, and those
seeking to enhance their recovery capital and maintain their recovery from substance
use disorders to the Substance Use Service Assistance Network (S.U.S.A.N.) Program.
b. Invite the S.U.S.A.N. Program to perform outreach during events or at the agencies
facility to inform clients of available services and supports.
c. Include the S.U.S.A.N. Program in client long-term recovery and discharge plans to allow
for additional case management and support.
d. Meet with S.U.S.A.N. caseworkers regularly to discuss available services for clients to
ensure that resources are used in an effective and sustainable manner and to confirm
that there is not a duplication of services among partnering agencies.
V. TERM OF AGREEMENT:
This agreement is to begin September 1, 2021 and shall terminate August 31, 2022. This
MOU may be extended for successive twelve (12) month terms by written agreement of the
parties. This MOU may be terminated by any party upon 30 days written notice to the other
party.
THE UNDERSIGNED AGENCIES do hereby certify that, (1) the services specified above are necessary and
essential for activities that are properly within the statutory functions and programs of the effected
agencies and (2) the proposed arrangements serve the interest of efficient and economical
administration.
THE CITY OF LUBBOCK HEALTH DEPARTMENT AND IT'S AGENTS further certify that it has the authority
to enter into this agreement for the above services under the provisions of Chapter 534 of the Texas
Health & Safety Code Ann., as amended.
Non -Arbitration: The City reserves the right to exercise any right or remedy available to it by law,
contract, equity, or otherwise, including without limitation, the right to seek any and all forms of relief in
a court of competent jurisdiction. Further, the City shall not be subject to any arbitration process prior
to exercising its unrestricted right to seek judicial remedy. The remedies set forth herein are cumulative
and not exclusive, and may be exercised concurrently. To the extent of any conflict between this
provision and another provision in, or related to, this document, this provision shall control.
Nonappropriation: All funds for payment by the City under this contract are subject to the availability of
an annual appropriation for this purpose by the City. In the event of nonappropriation of funds by the
City Council of the City of Lubbock for the goods or services provided under the contract, the City will
terminate the contract, without termination charge or other liability, on the last day of the then -current
fiscal year or when the appropriation made for the then -current year for the goods or services covered
by this contract is spent, whichever event occurs first. If at any time funds are not appropriated for the
continuance of this contract, cancellation shall be accepted by the Seller on thirty (30) days prior written
notice, but failure to give such notice shall be of no effect and the City shall not be obligated under this
contract beyond the date of termination.
SB252: SB 252 prohibits the City from entering into a contract with a vendor that is identified by The
Comptroller as a company known to have contracts with or provide supplies or service with Iran, Sudan
or a foreign terrorist organization.
