RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute
and on behalf of the City of Lubbock, Amendment No. 1 to the Professional Services Agreem
Contract No. 15977 for services related to elevated storage tank (EST) design and pressure zi
delineation, by and between the City of Lubbock and Freese and Nichols, Inc., and rela
documents. Said Amendment is attached hereto and incorporated in this resolution as if fully
forth herein and shall be included in the minutes of the City Council.

Amendment 1
To Agreement Between
The City of Lubbock, TX
And
Freese and Nichols, Inc.
THIS IS THE FIRST AMENDMENT TO THE AGREEMENT, Contract No. 15977, dated and entered
into the 22nd day of June 2021 by and between the City of Lubbock ("City") and Freese and Nichols, Inc.
("Engineer"), a Texas Professional Corporation, for providing engineering services elevated storage tank
(EST) design and pressure zone delineation ("Project").
WITNESSETH:
WHEREAS, the City desires to increase the scope of the work to be performed by Engineer on the Project
for bid and construction phase services for Bid Package #3 — 87" Street and 3`d Street ESTs and bid phase
services for Bid Package #4 — Clovis Highway EST. The details of work to be performed and associated
additional fees are described in Exhibit A, attached to and incorporated herein. The additional services
shall be provided for an amount not exceed one million one hundred eighty-nine thousand four hundred
seventy and 00/100 ($1,189,470.00). The original term of the agreement shall be extended for 709 days
for Engineer to complete the additional services described herein.
WHEREAS, all other portions of the original Agreement shall remain in place and are not altered by this
amendment.
NOW, THEREFORE, the City and Engineer agree to the terms of this FIRST AMENDMENT:
IN WITNESS HEREOF, the parties have executed this Agreement as of this _&th day of March
2022.

PROFESSIONAL SERVICES AGREEMENT
AMENDMENT NO. 1

Project Name: Elevated Storage Tank (EST) Design and Pressure Zone Delineation
Description of Services: The following services are included in this amendment:
• Bid Phase Services for Bid Package #3 — 871h Street and 3rd Street 2.0 MG ESTs
• Construction Phase Services for Bid Package #3 — 87th Street and 3`d Street 2.0 MG ESTs
DATE: 11/22/2021
o General Representation as outlined in the original contract.
o Resident Project Representation — 30 hours per week for 104 weeks
o Full -Time Surface Preparation and Coating Inspection Services during the interior and exterior coating
processes for the elevated tank.
■ Services include:
• Review of project plans and specifications to evaluate that proper surface preparation
and coating application techniques are being followed.
• Submittal of Daily Reports on the days of inspections, including a record of ambient
weather conditions, material batch numbers, general and sub -contractor information,
and a complete summary of work completed.
• Checking coating products to verify they meet specs.
• Checking blast material and anchor profiles of steel.
• Checking mixing and application of each of the coating products.
• Checking dry film thickness after each coat is cured and before next coat is applied.
• Monitoring testing of all immersed areas for pin -holes or holidays.
• Services include providing a coating inspector for a maximum of 84 site visits on each
tank. The estimated site visits for inspection is an assumption and the actual required
may vary depending on the Contractor's means, methods, and schedule. During
construction, FNI will track the inspector's hours and notify the City if additional hours
are required to complete the project.
• Welding inspection will be performed by contractor per AWWA D107. Boswell
consulting will visit the site one time for interpretation of X-ray film for weld testing.
Does not include providing X-ray crew and X-ray testing.
Bid Phase Services for Bid Package #4 — Clovis Highway 2.0 MG EST
Amended Schedule: June 22, 2022 completion date extended to May 31, 2024

Compensation shall be amended as follows: A not to exceed amount of $1,831,918.62
Current Contract Amount: $955,522.62
Amount of this Amendment: $1,189,470.00
Revised Total Amount Authorized: $2,144,992.62
The above described services shall proceed upon execution of this amendment. All other provisions, terms and
conditions of the Professional Services Agreement which are not expressly amended shall remain in full force and
effect.

OTHER DIRECT EXPENSES:
Other direct expenses are reimbursed at actual cost times a multiplier of 1.10. They include outside printing and reproduction
expense, communication expense, travel, transportation and subsistence away from the FNI office and other miscellaneous expenses
directly related to the work, including costs of laboratory analysis, test, and other work required to be done by independent persons
other than staff members. For Resident Representative services performed by non-FNI employees and CAD services performed In-
house by non-FNI employees where FNI provides workspace and equipment to perform such services, these services will be billed at
cost times a multiplier of 2.0. This markup approximates the cost to FNI if an FNI employee was performing the same or similar
services.
