LP&L - 02/09/2012First Reading February 9, 2012 Item No. 5.1 ORDINANCE NO. 2012-00013 Second Reading February 23, 2012 Item No. 5.1 AN ORDINANCE AMENDING THE FY 2011-12 BUDGET FOR MUNICIPAL PURPOSES RESPECTING THE GRANT FUND TO ACCEPT AND APPROPRIATE FUNDING FROM THE TEXAS DEPARTMENT OF PUBLIC SAFETY / TEXAS HOMELAND SECURITY STATE ADMINISTRATIVE AGENCY (DPS/THSSAA) FOR THE METROPOLITAN MEDICAL RESPONSE SYSTEM (MMRS), GRANT NO. 87070; RESPECTING THE GENERAL FUND AND THE EMERGENCY MANAGEMENT SPECIAL REVENUE FUND TO AMEND CIVIL SERVICE CLASSIFICATIONS AND POSITIONS; RESPECTING THE 2011-12 MASTER LEASE; RESPECTING THE LUBBOCK POWER & LIGHT (LP&L) CAPITAL PROGRAM, AS RECOMMENDED BY THE ELECTRIC UTILITY BOARD ON JANUARY 24, 2012, TO AMEND CAPITAL IMPROVEMENT PROJECT (CIP) NO. 92267, "FY 2011-12 OVERHEAD DISTRIBUTION"; CIP NO. 92268, "FY 2011-12 UNDERGROUND DISTRIBUTION"; AND PROJECT NO. 92269, "FY 2011-12 DISTRIBUTION TRANSFORMERS"; AND RESPECTING THE LP&L FUND, AS RECOMMENDED BY THE ELECTRIC UTILITY BOARD ON JANUARY 24, 2012, TO INCREASE TRANSFERS TO THE CAPITAL PROGRAM AND INCREASE THE UTILIZATION OF LP&L FUND NET ASSETS. WHEREAS, Section 102.010 of the Local Government Code of the State of Texas authorizes the City Council to make changes in the budget for municipal purposes; and WHEREAS, in accordance with the City Budget Ordinance the City Council shall approve all transfers between funds and departments; and WHEREAS, the City Council deems it advisable to change the FY 2011-12 Budget for municipal purposes and reallocate funds as follows; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City Council of the City of Lubbock hereby approves changes to the City of Lubbock Budget FY 2011-12 (Budget Amendment #9) for municipal purposes, as follows: I. Accept and appropriate $267,608 from DPS/THSSAA for the MMRS Grant to fund enhanced capabilities for detecting, deterring, preventing, and responding to potential threats of natural disasters and acts of terrorism and to support a mass casualty incident preparedness program. II. Amend civil service classifications and positions in the General Fund - Fire Department and in the Emergency Management Special Revenue Fund (Emergency Management) in accordance with Section 2.06.109 of the Code of Ordinances of the City by transferring one Division Chief position from Emergency Management to the General Fund. III. Amend the civil service classifications in the General Fund - Fire Department in accordance with Section 2.06.109 of the Code of Ordinances of the City by reclassifying three Fire Fighter positions to Equipment Operators and three Fire Fighter positions to Lieutenant positions. IV. Amend the civil service classifications in the General Fund - Police Department in accordance with Section 2.06.109 of the Code of Ordinances of the City by reclassifying one Sergeant position to a Police Officer position. V. Amend the FY 2011-12 Master Lease approved in Ordinance 2011- 00080 on September 8, 2011, by adding a Chevrolet Tahoe SUV for the Fire Department fleet at a cost of approximately $30,000. VI. Amend CIPs No. 92267, "FY 2011-12 Overhead Distribution"; No. 92268, "FY 2011-12 Underground Distribution"; and No. 92269, "FY 2011-12 Distribution Transformers" by changing the funding source from FY 2012 LP&L Certificates of Obligation to LP&L Fund net assets (cash reserves). VII. Amend the LP&L Operating Fund by increasing the transfer to the Capital Project Fund by $9 million and by utilitizing net assets (cash reserves) in the LP&L Fund by the same amount. SECTION 2. THAT a copy of the changes made to the City of Lubbock Budget pursuant to this Ordinance shall be filed with the City Secretary and County Clerk of Lubbock as required by law. SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
