HomeMy WebLinkAboutResolution - 2022-R0084 - Semi-Annual Report from CIAC for Impact Fee ProgramResolution No. 2022-R0084 Item No. 8.8 February 8, 2022 RESOLUTION WHEREAS, the City Council of the City of Lubbock (the "City Council") approved future land use assumptions and a capital improvements plan and on October 27, 2020; and WHEREAS, the City Council adopted Ordinance No. 2020-00136, establishing impact fees in the City of Lubbock to assist in the financing of capital improvements required by new development; and WHEREAS, the City Council created a committee on June 11, 2019 through Resolution No. 2019-R0202, named the Capital Improvements Advisory Committee (the "CIAO"), in accordance with the requirements of Section 395.058 of the Texas Local Government Code and for the purpose of: (1) Advising and assisting the political subdivision in adopting land use assumptions; (2) Review the capital improvements plan and file written comments; (3) Monitor and evaluate implementation of the capital improvements plan; (4) File semiannual reports with respect to the progress of the capital improvements plan and report to the political subdivision any perceived inequities in implementing the plan or imposing the impact fee; and (5) Advising the political subdivision of the need to update or revise the land use assumptions, capital improvements plan, and impact fee; and WHEREAS, the CIAC met on January 13, 2022 to hear updates from staff and consultants and recommendations regarding a need to update the adopted capital improvements plan and the impact fee ordinance; and NOW, THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the semi-annual Report of the CIAC and the recommendations therein are hereby accepted by the City Council. Said Report is attached hereto and incorporated within this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. Acceptance CIA Report 2022 1.27.2022 Resolution No. 2022-R0084 Semi Annual Progress Report Capital Improvements Advisory Committee for Roadway Impact Fees January 2022 CIAC Semi -Annual Report January 2022 Introduction This report was prepared by the City of Lubbock Engineering staff and adopted by the Capital Improvements Advisory Committee for Roadway Impact Fees ("CIAC"). The purpose of this report is to advise the City Council, in accordance with Chapter 395 of the Texas Local Government Code of the status of the Impact Fee Program. This report should include information with respect to the progress of the capital improvements plan (or capacity plan) and any perceived inequities in implementing the plan or imposing the impact fee. Program Overview and Status On October 27, 2020, Lubbock City Council adopted the impact fee ordinance (Ord. #2020- 00136). Impact fees are charges assessed by local governments on new development projects in order to partially fund roadway, wastewater, and water improvements that are necessitated by new development. These funds are offset by City of Lubbock funds to build the infrastructure as detailed in the capacity plans. The effective date set for the implementation of wastewater and water impact fees is June 1, 2022. These modifications are necessary due to recent and proposed annexations. Also recommend maintaining the current rates despite the minor modifications to the capacity plans based on the addition of newly annexed areas. • Ordinance Update Recommend an update to the ordinance to include provisions for future annexations. • Land use assumptions Recommend maintaining land use assumptions and growth rate for newly annexed areas. • Fee Revenues The total fee revenues collected through January 12, 2022 by service areas is as follows: Service Area Total Revenue A $15 935.70 B $0 C $0 D $0 E $11 808.73 F $0 G $0 H $0 • impact Fee Expenditures The total expenditures distributed through January 12, 2022 by service areas is as follows: Service Area Total Fees Distributed A $0 B $0 C $0 D $0 E $0 F $0 G $0 H $0 • Credit Agreements At this time, there have been no credit agreements submitted for review. Recommendations The CIAC submits the following recommendations for consideration by the City of Lubbock City Council: • The Roadway Impact Fee is being collected and maintained in accordance with state law and City code. • Recommend a minor update to the 2020 Roadway, Wastewater, and Water Impact Study to include the expansion and shifting of service area boundaries. • Recommend updating the current rates in the expanded service areas. • Recommend an update to the ordinance to include provisions for future annexations.
