HomeMy WebLinkAboutOrdinance - 2018-O0091 - Chapter 40 Amendment - Breweries - 08/09/2018First Reading July 26, 2018 Item No. 7.11 ORDINANCE NO. 2018-00091 Second Reading August 9, 2018 Item No. 7.21 AN ORDINANCE AMENDING CHAPTER 40, "ZONING," OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS BY ADDING BREWERY, BREWPUB, DISTILLERY, MICROBREWERY, MICRODISTILLERY, MICROWINERY, WINE TASTING FACILITY, BEER TASTING FACILITY, ALCOHOL TASTING FACILITY, AND WINERY AS PERMITTED OR CONDITIONAL USES IN CERTAIN COMMERCIAL ZONING DISTRICTS; AMENDING CHAPTER 40, "ZONING," OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS TO ADD DEFINITIONS, PARKING RATIOS, OUTSIDE STORAGE REQUIREMENTS, SEPARATION REQUIREMENTS, AND FLOOR AREA REQUIREMENTS THAT RELATE TO THE USES LISTED ABOVE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A CONSISTENCY IN APPLICATION CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Planning & Zoning Commission of the City of Lubbock, Texas (the "Commission"), during its meeting on July 5, 2018, found that it is in the best interest of the citizens of the City of Lubbock to amend Chapter 40 of the Code of Ordinances of the City of Lubbock (the "Code") by allowing for breweries, distilleries, wineries, and similar uses in certain commercial zoning districts throughout the City of Lubbock; and WHEREAS, the Commission unanimously recommends that the City Council of the City of Lubbock, Texas (the "Council") amend Chapter 40 of the Code to account for the Commission's approved amendment; and WHEREAS, the Council finds and determines that it is in the best interest of the health, safety, and welfare of the citizens of the City of Lubbock to amend Chapter 40 of the Code by adding breweries, distilleries, wineries, and similar uses to the Code and to amend all applicable parts of the Code to account for the new uses; and, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 40.01.003 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.01.003(25b), which said section reads as follows: "(25b) Brewer : A place where beer is manufactured or made commercially." SECTION 2. THAT Section 40.01.003 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.01.003(25c), which said section reads as follows: "(25c) Breii,pub: An establishment that sells beer that has been brewed on the premises, and which may include a restaurant." Chapter 40—Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 1 SECTION 3. THAT Section 40.01.003 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.01.003(52a), which said section reads as follows: "(52a) Distillery: A place where liquor is manufactured or made commercially." SECTION 4. THAT Section 40.01.003 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.01.003(97a), which said section reads as follows: "(97a) Microbrewery, Microdistillery, or Microwinery: A small, independently owned establishment where beer, wine, or other alcoholic beverage is brewed, fermented, or distilled for on premises consumption and distribution." SECTION 5. THAT Section 40.01.003(195) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "(195) Wine, Beer, or Alcohol TastinZ Facility: A facility or a portion of a facility that is a part of a winery, brewery, or a distillery, typically located on the premises of the winery, brewery, or distillery's production facilities, at which guests may sample the winery, brewery, or distillery's products. A tasting facility may include meeting or banquet facilities or restaurants to dispense wine for on premise consumption." The existing definition of "Winery " in Section 40.01.003(195) should be replaced with the definition provided in this Section. SECTION 6. THAT Section 40.01.003(196) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "(196) Winer : A place where wine is manufactured or made commercially." The existing language in Section 40.01.003(196) should be replaced with the language provided in this Section. SECTION 7. THAT Section 40.03.1394 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1394(3a), which said section reads as follows: "(3a) Brewpub" SECTION 8. THAT Section 40.03.1394 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1394(8a), which said section reads as follows: "(8a) Microbrewery, Microdistillery, or Microwinery" Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 2 SECTION 9. THAT Section 40.03.1394 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1394(14), which said section reads as follows: "(14) Wine, Beer, or Alcohol Tasting Facility" SECTION 10. THAT Section 40.03.1396 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1396(d), which said section reads as follows: "(d) Separation requirements for certain uses: Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-IA, R-2 or A- L" SECTION 11. THAT Section 40.03.1400 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "See. 40.03.1400 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.1400 should be replaced with the language provided in this Section. SECTION 12. THAT Section 40.03.1402 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1402(a)(14), which said section reads as follows: "(14) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall provide one (1) parking space per one hundred seventy-five square feet (175 sq ft) of the retail, tasting, or eating area, and one (1) parking space per two thousand square feet (2,000 sq ft) of the manufacturing or storage area." THAT Section 40.03.1403 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1403(e), which said section reads as follows: "(e) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." SECTION 14. THAT Section 40.03.1514 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1514(1 b), which said section reads as follows: "(1 b) Brewpub" SECTION 15. THAT Section 40.03.1514 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1514(13a), which said section reads as follows: "(13a) Microbrewery, Microdistillery, or Microwinery" SECTION 16. THAT Section 40.03.1514 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1514(22), which said section reads as follows: "(22) Wine, Beer, or Alcohol Tasting Facility" SECTION 17. THAT Section 40.03,1516 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1516(d), which said section reads as follows: "(d) Separation requirements for certain uses: Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1. R-IA, R-2 or A- I." SECTION 18. THAT Section 40.03.1520 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.1520 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 4 (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.1520 should be replaced with the language provided in this Section. SECTION 19. THAT Section 40.03.1522 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1522(a)(8), which said section reads as follows: "(8) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall provide one (1) parking space per one hundred seventy-five square feet (175 sq ft) of the retail, tasting, or eating area, and one (1) parking space per two thousand square feet (2,000 sq ft) of the manufacturing or storage area." SECTION 20. THAT Section 40.03.1634 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1634(1 b), which said section reads as follows: "(1 b) Brewpub" SECTION 22. THAT Section 40.03.1634 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1634(4a), which said section reads as follows: "(4a) Microbrewery, Microdistillery, or Microwinery" SECTION 23. THAT Section 40.03.1634(10) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "(10) Wine, Beer, or Alcohol Tasting Facility" Chapter 40 —Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 5 The existing language in Section 40.03.1634(10) should be replaced with the language provided in this Section. SECTION 24. THAT Section 40.03.1636 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1636(d), which said section reads as follows: "(d) Separation requirements for certain uses: Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-IA, R-2 or A-L" SECTION 25. THAT Section 40.03.1640 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "See. 40.03.1640 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.1640 should be replaced with the language provided in this Section. SECTION 26. THAT Section 40.03.1642 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1642(a)(9), which said section reads as follows: "(9) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall provide one (1) parking space per one hundred seventy-five square feet (175 sq ft) of the retail, tasting, or eating area, and one (1) parking space per two thousand square feet (2,000 sq ft) of the manufacturing or storage area." SECTION 27. THAT Section 40.03.1643 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1643(e), which said section reads as follows: "(e) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 6 shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." SECTION 28. THAT Section 40.03.1753 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1753(12a), which said section reads as follows: "(12a) Brewpub" SECTION 29. THAT Section 40.03,1753 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1753(44a), which said section reads as follows: "(44a) Microbrewery, Microdistillery, or Microwinery" SECTION 30. THAT Section 40.03.1753 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1753(68), which said section reads as follows: "(68) Wine, Beer, or Alcohol Tasting Facility" SECTION 31. THAT Section 40.03.1755 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1755(e), which said section reads as follows: "(e) Separation requirements for certain uses: Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-IA, R-2 or A- L" SECTION 32. THAT Section 40.03.1759 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "See. 40.03.1759 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge. or similar use." SECTION 33. THAT Section 40.03.1761 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1761(a)(13), which said section reads as follows: "(13) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer "fasting Facility, or Alcohol Tasting Facility shall not be required to provide off-street parking." SECTION 34. THAT Section 40.03.1764 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.17640), which said section reads as follows: " o) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." SECTION 35. Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 8 separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A-1." The existing language in Section 40.03.1881 should be replaced with the language provided in this Section. SECTION 37. THAT Section 40.03.1882 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.1882(a)(15), which said section reads as follows: `*(15) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall not be required to provide off-street parking." SECTION 38. THAT Section 40.03.1885 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.18850), which said section reads as follows: " o) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.1999 should be replaced with the language provided in this Section. SECTION 40. THAT Section 40.03.2001 of the Code of Ordinances, City of Lubbock. Texas is hereby amended to read as follows: Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 9 "Sec.40.03.2001 Separation Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A-1." The existing language in Section 40.03.2001 should be replaced with the language provided in this Section. SECTION 41. THAT Section 40.03.2002 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2002(a)(15), which said section reads as follows: "(15) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall not be required to provide off-street parking." SECTION 42. THAT Section 40.03.2005 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2005(i), which said section reads as follows: "(i) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." SECTION 43. THAT Section 40.03.2119 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.2119 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.2119 should be replaced with the language provided in this Section. Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 10 SECTION 44. THAT Section 40.03.2121 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.2121 Separation (a) No bar, cocktail lounge, private club, nightclub dance hall, brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility shall be located within six hundred feet (600') of any established bar, lounge, private club, nightclub, dance hall, brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility. This distance shall be measured in a direct line from front door to front door. (b) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A- L" The existing language in Section 40.03.2121 should be replaced with the language provided in this Section. SECTION 45. THAT Section 40.03.2122 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2122(a)(15), which said section reads as follows: "(15) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall provide one (1) parking space per one hundred seventy-five square feet (175 sq ft) of the retail. tasting, or eating area, and one (1) parking space per two thousand square feet (2,000 sq ft) of the manufacturing or storage area." SECTION 46. THAT Section 40.03.2125 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2125(i), which said section reads as follows: "(i) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." SECTION 47. THAT Section 40.03.2153 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2153(l la), which said section reads as follows: Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 11 "(11 a) Brewpub" SECTION 48. THAT Section 40.03.2153 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2153(36a), which said section reads as follows: "(36a) Microbrewery, Microdistillery, or Microwinery" SECTION 49. THAT Section 40.03.2153 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2153(57), which said section reads as follows: "(57) Wine, Beer, or Alcohol Tasting Facility" SECTION 50. THAT Section 40.03.2159 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.2159 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.2159 should be replaced with the language provided in this Section. SECTION 51. THAT Section 40.03.2161 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.2161 Separation Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A-1." The existing language in Section 40.03.2161 should be replaced with the language provided in this Section. SECTION 52. THAT Section 40.03.2162 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2162(a)(15), which said section reads as follows: Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 12 "(15) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall not be required to provide off-street parking." SECTION 53. THAT Section 40.03.2165 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.21650), which said section reads as follows: "o) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." SECTION 54. THAT Section 40.03.2183 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2183(3a), which said section reads as follows: "(3a) Brewpub" SECTION 55. THAT Section 40.03.2183 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2183(9a), which said section reads as follows: "(9a) Microbrewery, Microdistillery, or Microwinery" SECTION 56. THAT Section 40.03.2183 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2183(20a), which said section reads as follows: "(20a) Wine, Beer, or Alcohol Tasting Facility" SECTION 57. THAT Section 40.03.2189 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.2189 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." R-2, or A- L" The existing language in Section 40.03.2191 should be replaced with the language provided in this Section. SECTION 59. THAT Section 40.03.2192 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2192(a)(4a), which said section reads as follows: "(4a) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall not be required to provide off-street parking.'' SECTION 60. THAT Section 40.03,2195(e) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: (e) Outdoor storage. All storage areas and fencing shall be behind the front building line. (2) All outside storage areas for any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. THAT Section 40.03.2233(67) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "(67) Wine, Beer, or Alcohol Tasting Facility" The existing language in Section 40.03.2233(67) should be replaced with the language provided in this Section. SECTION 64. THAT Section 40.03.2240 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "See. 40.03.2240 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. THAT Section 40.03.2242 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "See.40.03.2242 Separation (a) Any bar, cocktail lounge, private club, nightclub or dance hall shall be located a minimum of two hundred feet (200') from any residentially zoned property. (This distance shall be measured in a direct line from the nearest wall of the structure in which the use is located to the residential district line.) This distance shall be measured in a direct line from front door to front door. (b) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A- L" The existing language in Section 40.03.2242 should be replaced with the language provided in this Section. SECTION 66. The existing language in Section 40.03.2243(a)(15) should be replaced with the language provided in this Section. SECTION 67. (1) Wholesale sales or services, display areas and offices - One (1) space per three hundred square feet (300 sq ft) of gross floor area. (2) Warehousing or storage in conjunction with wholesale sales or services - One (1) space per two thousand square feet (2,000 sq ft) of gross display area. (3) Outside display areas -- One (1) space per two thousand square feet (2,000 sq ft) of gross display area. (4) Manufacturing uses - - One (1) space per one hundred seventy-five square feet (175 sq ft) of gross floor area devoted to sales, service, display, or offices; one (1) space per two thousand square feet (2,000 sq ft) of gross floor area devoted to manufacturing, plus one (1) space per two thousand square feet (2,000 sq ft) of gross floor area devoted to storage or other uses. (5) Warehousing (storage only) or outside storage areas - One (1) space per five thousand square feet (5,000 sq ft) of gross floor area or lot area. This distance shall be measured in a direct line from front door to front door. (b) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A-1." SECTION 94. THAT Section 40.03.2734(e) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "(e) Outside storage. THAT Section 40.03.2734 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2734(i), which said section reads as follows: Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 23 "(i) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A-1." SECTION 96. THAT Section 40.03.2843 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2843(l lb), which said section reads as follows: "(11 b) Brewpub" SECTION 97. THAT Section 40.03.2843 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2843(40a), which said section reads as follows: "(40a) Microbrewery, Microdistillery, or Microwinery" SECTION 98. THAT Section 40.03.2844 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2844(3), which said section reads as follows: "(3) Brewery" SECTION 99. THAT Section 40.03.2844 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2844(4), which said section reads as follows: "(4) Distillery" SECTION 100. THAT Section 40.03.2844 of the Code of Ordinances, City of Lubbock. Texas is hereby amended by adding a section to be numbered 40.03.2844(5), which said section reads as follows: "(5) Wine, Beer, or Alcohol Tasting Facility" SECTION 101. THAT Section 40.03.2844 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2844(6), which said section reads as follows: "(6) Winery" SECTION 102. THAT Section 40.03.2849 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Chapter 40 —Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 24 "Sec. 40.03.2849 Floor area ratio (a) Unless otherwise provided for in this Section, there shall be no floor area ratio requirement for any use in this District. (b) Any Brewpub, Microbrewery, Microdistillery, or Microwinery shall be limited to a maximum total floor area of twenty thousand square feet (20,000 sq ft), with a minimum of ten percent (10%) of floor area dedicated to a restaurant, bar, lounge, or similar use." The existing language in Section 40.03.2849 should be replaced with the language provided in this Section. SECTION 103. THAT Section 40.03.2851 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 40.03.2851 Separation (a) Any bar, cocktail lounge, private club, nightclub or dance hall shall be located a minimum of two hundred feet (200') from any residentially zoned property. (This distance shall be measured in a direct line from the nearest wall of the structure in which the use is located to the residential district line.) No bar, cocktail lounge, private club, nightclub, dance hall, brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility shall be located within six hundred feet (600') of any established bar, lounge, private club, nightclub, dance hall, brewpub, microbrewery, microdistillery, microwinery, wine tasting facility, beer tasting facility, or alcohol tasting facility. This distance shall be measured in a direct line from front door to front door. (b) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall meet all State and other separation requirements and be located a minimum of three hundred feet (300') from any property zoned RR, R-1, R-1 A, R-2, or A-1." The existing language in Section 40.03.2851 should be replaced with the language provided in this Section. SECTION 104. THAT Section 40.03.2852 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2852(c), which said section reads as follows: "(c) Any Brewpub, Microbrewery, Microdistillery, Microwinery, Wine Tasting Facility, Beer Tasting Facility, or Alcohol Tasting Facility shall provide one (1) parking space per one hundred seventy-five square feet (175 sq ft) of the retail, tasting, or eating area, and one (1) parking space per two thousand square feet (2,000 sq ft) of the manufacturing or storage area." THAT Section 40.03.2855(e) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "(e) Outside storage. (1) Unless otherwise provided for in this Section, no outside storage allowed shall be allowed in this District. (2) Outside storage areas shall be allowed for any Brewpub, Microbrewery, Microdistillery, or Microwinery, as long as such storage area shall be screened by a minimum six-foot (6') masonry screening fence that reasonably matches the fagade of the structure. Materials shall not be stacked or stored to exceed the height of the screening fence. All storage and fencing shall be located behind the front building line." The existing language in Section 40.03.2855(e) should be replaced with the language provided in this Section. SECTION 106. THAT Section 40.03.2963 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2963(6a), which said section reads as follows: "(6a) Brewery" SECTION 107. THAT Section 40.03.2963 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2963(6b), which said section reads as follows: "(6b) Brewpub" SECTION 108. THAT Section 40.03.2963 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2963(18a), which said section reads as follows: "(18a) Distillery" SECTION 109. THAT Section 40.03.2963 of the Code of Ordinances, City of Lubbock, Texas is hereby amended by adding a section to be numbered 40.03.2963(32a), which said section reads as follows: "(32a) Microbrewery, Microdistillery, or Microwinery" SECTION 110. THAT Section 40.03.2963(67) of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: Chapter 40 — Additions & Amendments for Breweries, Distilleries, Wineries, and Similar Uses Page 26 "(67) Wine, Beer, or Alcohol Tasting Facility" The existing language in Section 40.03.2963(67) should be replaced with the language provided in this Section. THAT, violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No1100 Dollars ($2,000.00) as provided in Section 40.01.006 of the Zoning Ordinance of the City of Lubbock. SECTION 116. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 117. THAT the intent of this Ordinance is to apply consistent changes to any portion of the Code of Ordinances of the City of Lubbock that is or may be affected by the changes provided herein. This Ordinance is also intended to apply consistent changes to any Ordinance that has been approved by the City Council of the City of Lubbock that is or may be affected by the changes provided herein. If this Ordinance has omitted any portion of the Code of Ordinances or any other Ordinance that should otherwise be affected by the changes provided herein, such omission is inadvertent and unintentional, and, upon the effective date of this Ordinance, any such omitted portion of the Code of Ordinances or other Ordinance shall be interpreted in such a manner as to comply with the changes provided herein. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
