HomeMy WebLinkAboutOrdinance - 2013-O0023 - Request To Amend Zoning To Allow Apartment In CB-2 District - 03/14/2013First Reading February 28, 2013 Item No. 6.8 Second Reading March 14, 2013 Item No. 5.22 ORDINANCE NO. 2on_000n AN ORDINANCE AMENDING CHAPTER 40, "ZONING", ARTICLE 40.03, "DISTRICTS", DIVISION 17, "CB-2, CENTRAL BUSINESS DISTRICT, BROADWAY/13TH/MAIN, SECTION 40.03.1873, "PERMITTED USES", OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, TO ALLOW FOR APARTMENTS; CHAPTER 40, "ZONING", ARTICLE 40.03, "DISTRICTS," SECTION 40.03.1882(a)(9), "OFF-STREET PARKING REQUIREMENTS" OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, TO ESTABLISH PARKING STANDARDS FOR APARTMENTS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock, Texas deems it in the best interest of the health, safety, and welfare of the citizens of Lubbock to amend the Code of Ordinances to clarify the standards applicable to apartments in the "CB-2 Central Business District" zoning district and to establish parking standards, as set forth herein; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 40.03.1873 subsection (4) of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: (4) Apartments. SECTION 2. THAT Section 40.03.1882 subsection (a)(9) of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: (9) Apartments — One space for each efficiency unit, one and one-half (1 '/z) spaces for each one bedroom unit, two (2) spaces for each unit with two (2) or more bedrooms, plus one additional space for each four (4) units in the development. Townhomes, garden homes, duplexes and single-family shall comply with the "R-I" and "R-2" parking standards. SECTION 3. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided by Section 1.01.004 of the Code of Ordinances of the City of Lubbock, Texas. SECTION 4. THAT should any paragraph, section, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of the Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary of the City of Lubbock, Texas, is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative means of publication provided by law. AND IT IS SO ORDERED.
