ORDINANCE NO. 2013-00022
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
FICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
ANGES: ZONE CASE NO. 3202; A ZONING CHANGE FROM T TO C-3
NING DISTRICT ON 10.833 ACRES OF UNPLATTED LAND OUT OF BLOCK
:, SECTION 5, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A
VINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
sented to the Planning and Zoning Commission for its recommendation which was
eived by the City Council and, after due consideration, the City Council found that due
changed conditions, it would be expedient and in the interest of the public health,
ety and general welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ordinance and Map have been fully complied with, including giving notices
in compliance with Section 40.01.005 of the Code of Ordinances, City of Lubbock,
Texas, and the notices provided by the Texas Local Government Code §211.007
(Vernon, 1990), and notice was duly published in the Lubbock Avalanche -Journal more
;than fifteen (15) days prior to the date of the public hearing before the City Council on
such proposed amendment, and the public hearing according to said notice, was held in
the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time
persons appeared in support of the proposal; and after said hearing, it was by the City
Council determined that it would be in the public interest, due to changed conditions, that
the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set
forth in the body of this Ordinance and this Ordinance having been introduced prior to
first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO.3202
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are

A change of zoning under the provisions of Section 40.01.005 of the Code of
Ordinances of the City of Lubbock from T to C-3 zoning district on 10.833 acres
of unplatted land out of Block AK, Section 5, City of Lubbock, Lubbock
County, Texas, located at Southwest corner of 130`h Street and Quaker
Avenue.
SECTION 2. THAT violation of any provision of this Ordinance shall be deemed
a misdemeanor punishable by fine not to exceed Two Thousand and No/100 Dollars
($2,000.00) as provided in Section 40.01.006 of the Zoning Ordinance of the City of
Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of
Ordinance be declared unconstitutional or invalid for any reason, the remainder of
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause publication
descriptive caption of this Ordinance as an alternative method provided by law.

METES AND BOUNDS DESCRIPTION of a 10.833 acre tract of land out of a 615.8 acre tract as described
under County Clerk File No. 2011011733 of the Official Public Records of Lubbock County, Texas, located in
Section 5, Block AK, Lubbock County, Texas, being further described as follows:
BEGINNING at a "cross" hatch nail with washer set for the Northeast comer of said Section 5, Block AK and the
Northeast comer of said 615.8 acre tract, same being the Northeast comer of this tract;
THENCE S. 00006'02" W., along the East line of said Section 5 and the Eastem boundary of said 615.8 acre tract,
at 40.00 feet pass a "cross" hatch nail with washer set in the South right-of-way line of F.M. 1585 as described in
Volume 497, Page 47 of the Deed Records of Lubbock County, Texas, continuing for a total distance of 660.00
feet to a 12" iron rod with cap set for the Southeast comer of this tract, from whence a found 3/4" square tube
bears S. 00006'02" W. a distance of 1980.65 feet;
THENCE N. 8905444" W. a distance of 715.00 feet to a 1/2" iron rod with cap set for the Southwest comer of this
tract;
THENCE N. 00006'02" E. at 620.00 feet pass a 12" iron rod with cap set in said South right -of --way line,
continuing for a total distance of 660.00 feet to a "cross" hatch nail with washer set in the North line of said
Section 5 and the Northern boundary of said 615.8 acre ham for the Northwest comer of this tract;
THENCE S. 8905444" E., along the North line of said Section 5 and the Northern boundary of said 615.8 acre
tract, a distance of 715.00 feet to the Point of Beginning.
Contains: 471,900 square feet.
Bearings are relative to the North line of Section 5, Block AK, previously recognized as being S. 89054'44" E
