AN ORDINANCE AMENDING CHAPTER 22 OF THE CODE OF ORDINANCES
OF THE CITY OF LUBBOCK, TEXAS, AMENDING ARTICLES 22.03 "WATER
GENERALLY" AND 22.04 "WASTEWATER SYSTEM" IN ORDER TO ALLOW
FOR CERTAIN UTLITY CONTRACTORS TO TAP CERTAIN CITY OF
LUBBOCK UTILITY MAINS FOR WATER AND SEWER; PROVIDING A
PENTALY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the City Council of the City of Lubbock deems it in the best interest of the
citizens of Lubbock, and for the efficient handling of current and future development, to
approve certain water and sewer tap installation by certain City of Lubbock -approved utility
contractors; and
WHEREAS, adopting this change in policy will allow for quicker processing of water
and sewer tap installations as the City experiences significant, ongoing development; and
WHEREAS, the City Council of the City of Lubbock, Texas deems it in the best interest
of the citizens of Lubbock to make the following amendments to Chapter 22 of the Code of
Ordinances with regard to water and sewer taps; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
Section 1. THAT Section 22.03.018, of the Code of Ordinances of the City of
Lubbock, Texas, is hereby amended to read as follows:
Sec. 22.03.018 Tapping mains
Taps on the water main shall be performed by the City of Lubbock or by a City -approved
utility contractor with a minimum Class C Water License as issued by the State of Texas. All
connections to the City water (distribution) system for residential or other use shall be made
in such a way that all water received from the City water system shall be consumed or
discharged into an approved sewage disposal system and shall not be intentionally returned
to the City water system.
Section 2. THAT Section 22.03.090, of the Code of Ordinances of the City of
Lubbock, Texas, is hereby amended to read as follows:
Sec. 22.03.090 Water service (water tap) connections
(a) The customer shall select a City -approved utility contractor to install water taps for
residential and commercial taps of 2-inches or less. The utility contractor shall be registered
with the City's Engineering Department and shall have a current Class C water operator
license with the Texas Commission on Environmental Quality.
(b) Construction of the water tap and sewer lateral connection shall conform to the City of
Lubbock Engineering Minimum Design Standards and Specifications.
(c) The utility contractor shall notify the City Engineer at least 48 hours prior to construction
and within 72 hours of the completion of construction. The City will issue a notice of
completion within 72 hours of the utility contractor notifying the City. Then, the customer
can request and pay the appropriate fee for the desired size water meter.
Section 3. THAT Division 2, Section 22.04.045, of the Code of Ordinances of the
City of Lubbock, Texas, is hereby amended to read as follows:
Division 2. Sewer Service
Sec. 22.04.045 Sewer service connections
(a) The customer shall select a City -approved utility contractor to connect lateral sewer
connections for residential and commercial land uses. The utility contractor shall be
registered with the City's Engineering Department and shall have a current Class II
Wastewater Operator license with the Texas Commission on Environmental Quality.
(b) Construction of the sewer lateral connection shall conform to the City of Lubbock
Engineering Minimum Design Standards and Specifications.
(c) The customer or the customer's contractor shall acquire the proper permits and comply
with all applicable laws, ordinances, and policies for the maintenance, repair and
operation of this lateral line. Physical obstructions in the city's right-of-way, such as
landscaping, irrigation systems, fencing, or other such surface or subsurface obstructions
may potentially be damaged by excavation activity. The contractor, at its discretion, may
proceed with installing, repairing, or replacing the sewer tap or lateral service line located
in the city right-of-way, through or past the obstruction. The repair or replacement of any
obstructions placed in the easement or right-of-way, by the property owner or occupant of
the facility being served, or any individual, is the sole responsibility of said owner or
occupant.
(d) The utility contractor shall notify the appropriate city staff at least 48 hours prior to
construction and within 72 hours of the completion of construction. The City will issue a
notice of completion within 72 hours of the contractor notifying the City. Then, the
customer can request and pay the appropriate fee for the desired size water meter.
Section 4. THAT violation of any provision of this Ordinance shall be deemed a
misdemeanor punishable by a fine not to exceed applicable fines in accordance with Section
1.01.004 of the City Code of Ordinances
Section 5. THAT should any paragraph, sentence, clause, phrase or work of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby
Section 6. THAT the City Secretary is hereby authorized to cause publication of the
descriptive caption of this Ordinance as an alternative method provided by law.
