AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A RIGHT-

OF -WAY EASEMENT LOCATED IN SECTION 4, BLOCK AK, LUBBOCK COUNTY,
TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS

ORDINANCE; RESERVING A UTILITY EASEMENT; DIRECTING THE CITY
r
ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID
ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING FOR PUBLICATION.

WHEREAS, the City Council finds that the right-of-way easement hereinafter

described in the body of this Ordinance is no longer needed for right-of-way easement
purposes and for public use; and it would be in the public interest to close, vacate and

abandon the same for right-of-way easement purposes and for public use; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the right-of-way easement as hereinafter described shall BE
and the same is hereby closed, vacated and abandoned for right-of-way easement purposes
and for public use, such right-of-way easement being more particularly described in Exhibit
«A
SECTION 2. THAT an easement is hereby reserved on the property described in
Section 1, above, and such easement is reserved and retained for utility easement purposes
with the right of ingress and egress at all times for such purpose, and an easement is also
reserved for any and all existing pipelines or other utilities within said property together with
all rights appurtenant to the continuation of such utilities.
SECTION 3. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
SECTION 4. THAT should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 5. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.

METES AND BOUNDS DESCRIPTION of a 0.5154 acre tract of land being a portion of a right-of-way easement
as described in Volume 1486, Page 696 of the Deed Records of Lubbock County, Texas, located in Section 4,
Block AK, Lubbock County, Texas, being further described as follows:
BEGINNING at a point for the Southeast corner of this tract which bears N. 88°12'49" W. a distance of 55.00 feet
from a cross hatch nail with washer found (HRA) at the Southeast corner of Section 4, Block AK, Lubbock County,
Texas;
THENCE N. 88°12'49" W., along the South line of said Section 4, Block AK and the Southern boundary of said
right-of-way easement, a distance of 10.00 feet to a cross hatch nail found at the Southwest corner of said
right-of-way easement and the Southwest corner of this tract;
THENCE N. 01 °49'49" E., along the Western boundary of said right-of-way easement, a distance of 2641.63 feet
to a 1/2" iron rod with cap found (HRA) at the Northwest corner of said right-of-way easement and the Northwest
corner of this tract;
THENCE S. 88°08'42" E., along the Northern boundary of said right-of-way easement, a distance of 7.00 feet to a
point for the Northeast corner of this tract, from whence a found 1" square tube bears S. 88°08'42" E. a distance
of 55.00 feet;
THENCE S. 01°45'55" W., 55.00 feet West of and parallel with the East line of said Section 4, Block AK, a
distance of 2641.63 feet to the Point of Beginning.
Bearings are relative to Grid North, Texas Coordinate System of 1983, North-Central Zone, (2011, epoch 2010.0)
