ORDINANCE NO. 2000-00067
AN ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS BY ADDING SECTION
23-33 TO THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK BY
PROVIDING FOR A FIVE PERCENT (5%) PENALTY FOR ALL PAST DUE
SOLID WASTE DISPOSAL CHARGES; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATION.
WHEREAS, the City of Lubbock operates and manages a refuse collection and
solid waste disposal system for the benefit and use of the citizens of the City of Lubbock;
and
WHEREAS, pursuant to Chapter 23, Article I of the Lubbock Code of
Ordinances, the City of Lubbock provides for solid waste disposal and refuse collection
and implements charges related thereto;
WHEREAS, Chapter 23, Article I, Section 23-23 of the Lubbock Code of
Ordinances, provides for the billing of disposal charges to any person who successfully
applies for such billing; and
WHEREAS, the City Council of the City of Lubbock deems it to be in the best
interest of the citizens of the City of Lubbock to provide a penalty for the late payment of
solid waste disposal charges billed by the City of Lubbock; NOW THEREFORE:
SECTION 1: THAT the Code of Ordinances, City of Lubbock, Texas, is hereby
amended by adding a section, to be numbered Section 23-33, which said section reads as
follows:
Section 23-33. When bills due and payable.
(a) All bills for solid waste disposal charges shall be due and
payable fifteen (15) days after issuance. A penalty of five (5) percent shall
be charged to any person, firm or institution that fails to pay his bill after
fifteen (15) days from issuance. The five (5) percent late payment penalty
shall apply to all classes of consumers served.
(b) As used in this section, date of issuance shall mean the date in
when a bill is placed in the United States Mail, properly addressed to the
person, firm or institution.
SECTION 2: THAT the City Council finds and declares that sufficient written
notice of the date, hour, place and subject of this meeting of the Council was posted at a
designated place convenient to the public at the City Hall for the time required by law
preceding this meeting, that such place of posting was readily accessible at all times to
the general public, and that all of the foregoing was done as required by law at all times
during which this Ordinance and the subject matter thereof has been discussed,
considered and formally acted upon.
The City Council further ratifies, approves and confirms such written notice and
the contents of posting thereof.
SECTION 3: THAT should any paragraph, sentence, clause, phrase, or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of
this Ordinance shall not be affected thereby.
SECTION 4: THAT the City Secretary is hereby authorized and directed to
cause publication of the descriptive caption of this Ordinance as an alternative method of
publication provided by law.
AND IT IS SO ORDERED
Passed by the City Council on the first reading on this 7th day of
November , 2000.
Passed by the City Council on the second reading on this 12th day of
April ' 2001.
