First Reading Second Reading October 26, 2000 File And Return To November 7, 2000 Item No. 19 Ed Bucy R-p_yy Item No. 17 ' VOL 6876PACE 64 ORDINANCE NO. 2000-00059 AN ORDINANCE ABANDONING AND CLOSING AN UNDERGROUND UTILITY EASEMENT LOCATED IN THE NORTHRIDGE ADDITION TO THE CITY OF LUBBOCK, LU13BOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easement as hereinafter described in the body of this Ordinance'lis no longer needed for public use and it would be in the public interest to close, vacate for easement purposes and for public use and it would be in the public interest to close, vacate and abandon the same for easement purposes and public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described as follows: BEGINNING at a point in the East right-of-way line of Canyon Road, said point being North 50053' East, 50 feet from the Southeast corner of Lot 17, Northridge Addition; THENCE North 46026' West along the East right-of-way line of Canyon Road 5 feet to a point; THENCE North 50053' East 120 f to a point being in the property line of Lot 42; THENCE Southeasterly along the property line of Lot 42, 10 feet to a point; THENCE South 50053' West 120 feet t to a point being in the East right-of- way line of Canyon Road; THENCE North 46026' West along the East right-of-way line of Canyon Road 5 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. VOL 68 (6PAGE 65 SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED. Passed by the City Council on first reading this 26thday of October, 2000. Passed by the City Council on second reading the 7th day of November 2000.
