HomeMy WebLinkAboutOrdinance - 2000-O0034 - Determining The Necessity Of Paving - 07/27/2000First Reading July 13, 2000 Item No. 13 ORDINANCE NO. 2000-00034 Second Reading July 27, 2000 Item No. 15 AN ORDINANCE DETERMINING THE NECESSITY OF THE PAVING OF A CERTAIN PORTION OF THE WEST SIDE OF UNIVERSITY AVENUE FROM 178 FEET SOUTH OF THE SOUTH END OF RADIUS OF 86TH STREET SOUTHWARD A DISTANCE OF 780 FEET, DETERMINING THE PUBLIC BENEFIT IN PARTICIPATING WITH THE DEVELOPER OF THE PROPERTY ABUTTING THE SAID PORTION OF UNIVERSITY AVENUE, DETERMINING ENGINEERING AND CONSTRUCTION COSTS, DETERMINING THE MAXIMUM AMOUNT OF THE COSTS OF SUCH PARTICIPATION FOR WHICH THE CITY SHALL BE LIABLE WHEREAS, a certain portion of the west side of University Avenue from 178 feet south of the south end of radius of 86' Street southward a distance of 780 feet is unpaved; WHEREAS, Subchapter C, Chapter 212 of the Texas Local Government Code authorizes municipalities with 50,000 or more inhabitants enter into contracts with developers of land in the municipality to construct certain public improvements; WHEREAS, Lubbock Land Company is the owner and developer of property abutting the said portion of University and desires that same be paved; WHEREAS, the City Council determines that it is in the best interest of the citizens of the City of Lubbock to participate in the cost of the said paving project in an amount not to exceed thirty percent (30%) of the total contract price not to exceed $20,529.54; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: The City Council finds that it is in the best interest of the citizens of the City of Lubbock for the said portion of University Avenue be paved. SECTION 1. THAT the City Council finds that it is in the best interests of the citizens of the City of Lubbock for the City to participate in the construction and paving of a portion of the west side of University Avenue from 178 feet south of 86' Street southward 780 feet in an amount not to exceed $20,529.54. $19,059.54 of said amount shall be paid to the construction contractor, $1,470.00 shall be paid to Lubbock Land Company for engineering costs. Said amounts shall be paid in a lump sum to the contractor and Lubbock Land Company at the conclusion of the said project. SECTION 2. THAT this ordinance shall become effective from and after its passage and publication as required by law. AND IT IS SO ORDERED.
