HomeMy WebLinkAboutOrdinance - 2000-O0029 - Amending Zoning Ordinance No.7084 - 06/08/2000First Reading May 25, 2000 Item No. 39 ORDINANCE NO. 2000-00029 Second Reading June 8, 2000 Item No. 17 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2882; A ZONING CHANGE FROM T TO IHC ZONING ON LOTS 3-12 WESTCOM ADDITION AND 27.72 ACRES OF LAND LOCATED IN THE NORTHWEST QUARTER OF SECTION 26, BLOCK AK ANDA 17.15 ACRE TRACT OF LAND LOCATED IN THE SOUTHWEST QUARTER OF SECTION 31, BLOCK AK, LUBBOCK, TEXAS; PROVIDING A PENALTY; SUBJECT TO CONDITIONS, PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully compiled with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche -Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinances and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO.2882 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from T to IHC zoning district on lots 3-12 Westcom Addition and 27.72 acres of land located in the Northwest quarter of Section 26, Block AK and a 17.15 acre tract of land located in the southwest quarter of Section 31, Block AK, City of Lubbock, Lubbock County, Texas, located North and South of 82nd Street between Wausau and Alcove Avenues and being further described as follows: TRACT A A 1.00 acre tract of land located in the Northwest Quarter of Section 26, Block A-K, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears South 55.0 feet and N. 89°56'30" E. 700 feet from the Northwest corner of Section 26, Block A-K, Lubbock County, Texas; THENCE N. 89056'30" E. a distance of 165 feet; THENCE South a distance of 264 feet; THENCE S. 89056'30" W. a distance of 165 feet; THENCE North a distance of 264 feet to the point of beginning. TRACT B METES AND BOUNDS DESCRIPTION of a 4.76 acre tract of land located in the Northwest Quarter of Section 26, Block AK, Lubbock County, Texas, being further described as follows: BEGINNING at the Northwest corner of Section 26, Block AK; THENCE South 691.4 feet; THENCE East 300 feet; THENCE North 691.4 feet; THENCE West 300 feet to the Point of Beginning. TRACT C Westcom Commercial Estates Lots 3 thru 12. TRACT D METES AND BOUNDS DESCRIPTION of a 17.15 tract of land located in the Southwest Quarter of Section 31, Block AK, Lubbock County, Texas, being further described as follows: Zone Case No. 2882 page - 2 of 4 BEGINNING at a point which bears N. 00'01'50" E. a distance of 55.00 feet from the Southwest corner of Section 31, Block AK, Lubbock County, Texas; THENCE N. 0000115" E., along the West line of Section 31, an approximate distance of 282.50; THENCE N. 89059140" E., parallel to the South line of Section 31, an approximate distance of 2643.82 feet to a point in the West plat limits line of Lots 1-136 and Tracts "A" and "B", Rancho Verde Estates; THENCE S. 00001'01" W., along said plat limits line, an approximate distance of 282.50 feet; THENCE S. 89059'40" W., 55.0 feet North of and parallel to the South line of Section 31, an approximate distance of 2643.90 feet to the Point of Beginning. TRACT E METES AND BOUNDS DESCRIPTION of a 21.22 acre tract of land located in the Northwest Quarter of Section 26, Block AK, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 89°56'30" E. a distance of 865.00 feet and South a distance of 55.00 feet from the Northwest corner of Section 26, Block AK, Lubbock County, Texas; THENCE N. 89056'30" E., 55.00 feet South of and parallel to the North line of Section 26, an approximate distance of 1777.23 feet to a point in the West plat limits line of Lots 1-71, West 82°d Street Commercial Park; THENCE S. 00000140" E., along said plat limits line, an approximate distance of 520.00 feet; THENCE S. 89056'30" W., parallel to the North line of Section 26, an approximate distance of 1777.13 feet to a point in the East plat limits line of Lots 1-11, Westcom' Commercial Estates; THENCE North, along said plat limits line, an approximate distance of 520.00 feet to the Point of Beginning. Zone Case No. 2882 page - 3 of 4 SUBJECT TO THE FOLLOWING CONDITION: 1. Prior to final plats for un-platted areas, the Planning and Zoning Commission shall approve a plan for the total number of curb cuts for lots with frontage to 82°d Street. SECTION 2. THAT violation of any provision of this Ordinance shall be deemed a misdemeanor punishable by fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
