AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF EMORY
STREET, DUKE STREET,', AND NORTH AVENUE V (ALSO KNOWN AS CANYON
VIEW DRIVE) AND A 10 FOOT FIRE HYDRANT AND WATER SUPPLY LINE
EASEMENT LOCATED 114 BLOCKS 1 AND 2, CANYON VIEW ADDITION TO
THE CITY OF LUBBOCK LUBBOCK COUNTY, TEXAS, AND MORE
PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE;
DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE
CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the street portions and easement portion
as hereinafter described in the body of this Ordinance is no longer needed for street and
easement purposes and for public use, and
WHEREAS, the City Council finds it would be in the public interest to close,
vacate and abandon the same for street and easement purposes and for public use; NOW
THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the street portions and easement portion as hereinafter
described shall BE and the same are hereby closed, vacated and abandoned for street and
easement purposes and for public use, and being more particularly described as follows:
TRACT 1
All of Emory Street, Duke Street, and North Avenue V (also known as Canyon
View Drive) which is situated between North Avenue U and North Vernon
Avenue, same being those rights -of -way dedicated by the plat of Canyon View
Addition recorded in Volume 419, Page 394, Deed Records of Lubbock County,
Texas.
TRACT 2
A fire hydrant and water supply line easement recorded in Volume 1527, Page
269 of the Deed Records of Lubbock County, Texas, and being further described
as follows:
BEGINNING at a point that is 390.50 feet North and 75.00 feet East of the
Southwest corner of said Canyon View Subdivision to the City of Lubbock,
Lubbock County, Texas, said point being in the East line of North Vernon
Avenue, recorded in Volume 1507, Page 963, Lubbock County Deed Records;
THENCE East 135.80 feet to a point in the West line of North Avenue V;

THENCE North 10.00 feet along the West line of North Avenue V;
THENCE West 135.80 feet to a point in the East line of North Vernon Avenue;
THENCE South 10.00 feet to the POINT OF BEGINNING.
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
the official maps of the City of Lubbock to reflect said abandonment and closing,
showing the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
word of this Ordinance be declared unconstitutional or invalid for any reason, the
remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance
as an alternative method provided by law.
AND IT IS SO ORDERED.
