HomeMy WebLinkAboutOrdinance - 2000-O0006 - Abandoning And Closing Ingress-Egress Easement - 03/02/2000First Reading Second Reading February 24, 2000 March 2, 2000 Item No. 21 File And Return To Item No. 10 Ed Svcy R-O-W 7392 VOL 6599 ci 54 ORDINANCE NO. 2000-00006 AN ORDINANCE ABANDONING AND CLOSING A 20 FOOT INGRESS - EGRESS EASEMENT LOCATED IN LOT 13, SPUR 327 BUSINESS PARK, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the CityCouncil finds that the easement as hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use and it would be in the public interest to close, vacate and abandon the same for easement purposes and public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described as follows: BEGINNING at a point which is 25.00 feet East of the Northwest corner of Lot 13, Spur 327 Business Park, an addition to the City of Lubbock, Lubbock County, Texas; THENCE East 20.00 feet along the North Lot Line of said Lot 13 to a point; THENCE South 200.05 feet along a line parallel to the West Lot Line of said Lot 13 to a point in the South Lot Line of said Lot 13; THENCE West 20.00 feet along the South Lot Line of said Lot 13 to a point; THENCE North 200.05 feet along a line parallel to the West Lot Line of said Lot 13 to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. i voL 6599PAGE 55 AND IT IS SO ORDERED.
