Item No. 17 ORDINANCE NO. 2000-00002 AN ORDINANCE ESTABLISHING THE DATE OF THE 2000 REGULAR MUNICIPAL ELECTION OF THE CITY OF LUBBOCK; AUTHORIZING THE MAYOR TO ORDER THE 2000 REGULAR MUNICIPAL ELECTION OF THE CITY OF LUBBOCK AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to establish the date of the regular municipal election for the year 2000 as May 6, 2000; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Regular Municipal Election for the City of Lubbock shall be conducted on May 6, 2000, under the applicable provisions of the Texas Election Code, the Lubbock City Charter and City ordinances. SECTION 2. THAT the election shall be held pursuant an appropriate election order to be issued by the Mayor hereafter in accordance with Sec. 3.004 of the Texas Election Code and all persons qualified to vote in the City of Lubbock under the election laws of the State of Texas shall be permitted to voted therein. SECTION 3. THAT this Ordinance shall take effect and be in full force immediately from and after its final approval and passage. AND IT IS SO ORDERED. Max In e, Mayor Pro Tem Kayti Darnell, City Secretary APPROVED AS TO FORM: City Attorney ddelect/Eldate00.ord January 3, 2000 ORDER AND NOTICE OF GENERAL CITY ELECTION THE STATE OF TEXAS § CITY OF —BOCK ELECTION ORDER I, Max Ince, Mayor Pro Tem of the City of Lubbock, Texas, by virtue of the authority vested in me by law, and according to the Texas Election Code, the Charter of the CiZle fLubbockdo herebyGeneralCityElection bedo6th day of May, 2000, such day being the first Saturday of said month, for the purpose of election the following officers of the City of Lubbock, Texas: MAYOR (AT LARGE) 2 YEAR TERM COUNCIL MEMBER, DISTRICT NO.2 4 YEAR TERM COUNCIL MEMBER, DISTRICT N0. 4 4 YEAR TERM COUNCIL MEMBER, DISTRICT NO.6 4 YEAR TERM MUNICIPAL JUDGE DIVISION 1(AT LARGE) 4 YEAR TERM* * Formerly a two year term, it was changed to a four year term by the Legislature in the 1999 Session. See Acts, 1999, 76� Leg., Ch. 691 (Sec. 30.00044, Texas Government Code). An electronic voting system shall be used for this election, including early voting. Said City General Election shall be held at the places in the City of Lubbock hereinafter designated as voting precincts and in the voting places designated in Exhibit A, Polling places shall be open from 7:00 7:00 p.m., and all electors shall vote in the precinct of their residence unless such precinct shall be consolidated with another precinct as provided by Exhibit A. The sealed ballot box procedure established by Subchapter C, Chapter 127, Texas Election Code, shall be used for this General City Election. The persons named in Exhibit A hereto are hereby appointed Judges and Alternate Judges to conduct said General City Election on May 6, 2000. Each presiding judge so named is authorized to appoint the number of clerks authorized by the Election Administrator, which number shall not be less than two (2) clerks nor more than six (6) clerks. The alternate judges shall serve as presiding judges in the event that the regularly appointed presiding judge is unable to serve. The alternate judge shall be appointed by the presiding judge to serve as one of the clerks in the event that the election is conducted by the regularly appointed presiding judge. Early voting by personal earance shall commence on the W day of April, 2000, and end on the 2' day app of May, 2000. Said early voting shall be conducted at the locations, days and hours indicated on Exhibit B hereto. ELECTION NOTICE The City Secretary of the City of Lubbock is hereby ordered to cause publication of this General City Election by publication of this Order and Notice of General City Election in a newspaper of general circulation at least once no earlier than the 30- day =fthG'en- the10 daybeforeeectonday.Order and City Election shall be posted not later than the 21S` day before election day on the bulleting board used for posting notices of meetings of the governing body and a notice of consolidation shall be posted not less than 20 day==tiosha n dayanyplaces not consolidated atthe lastprevious election, ll indicate the precinct consolidation and the location of the new polling place. POR CUANTO el Consejo Municipal de la Ciudad de Lubbock considera que es en el mejor inter6s de los ciudadanos de la Ciudad de Lubbock establecer la fecha de las elecciones municipales generates para el ano 2000 el dia 6 de mayo de 2000; AHORA POR LO TANTO: EL CONSEJO MUNICIPAL DE LA CIUDAD DE LUBBOCK DISPONE: SECCI6N 1. QUE las Elecciones Municipales Regulares para la Ciudad de Lubbock se celebren el dia 6 de mayo de 2000, a tenor de las disposiciones pertinentes del C6digo Electoral de Texas, la Carta Constitucional de la Ciudad de Lubbock y las Ordenanzas Municipales. SECCI6N 2. QUE las elecciones se celebraran seg6n el decreto de elecciones apropiado que sera emitido por el Alcalde en el futuro de conformidad con la Secci6n 3.004 del C6digo Electoral de Texas y que se permitira votar en estas elecciones a todas las personas que reunan los requisitos para votar en la Ciudad de Lubbock, de conformidad con las leyes electorales del Estado de Texas. SECCI6N 3. QUE esta Ordenanza tendra vigencia y entrara en vigor de manera inmediata desde el momento de su aprobaci6n y aceptaci6n. Y ASI SE ORDENA. Vandiver, Principal Abogado Municipal Adjunto ORDEN Y AVISO DE ELECCIONES MUNICIPALES GENERALES EL ESTADO DE TEXAS § CIUDAD DE LUBBOCK § ORDEN DE ELECCION Yo, Max Ince, Alcalde Interino de la Ciudad de Lubbock, Texas, en virtud de la autoridad que la ley me confiere y a tenor del C6digo Electoral de Texas, la Carta Constitucional de la Ciudad de Lubbock y la Ordenanza Municipal, mediante el presente documento decreto la celebraci6n de Elecciones Municipales Generales el dia 6 de mayo de 2000, siendo dicho dia el primer sdbado de dicho mes, con el prop6sito de elegir los siguientes oficiales de la Ciudad de Lubbock, Texas: ALCALDE (EN GENERAL) PLAZO DE 2 ANOS CONSEJERO MUNICIPAL, DISTRITO NO. 2 PLAZO DE 4 ANOS CONSEJERO MUNICIPAL, DISTRITO NO. 4 PLAZO DE 4 ANOS CONSEJERO MUNICIPAL, DISTRITO NO. 6 PLAZO DE 4 ANOS JUEZ MUNICIPAL, DIVISION 1 (EN GENERAL) PLAZO DE 4 ANOS* *Anteriormente con mandato de dos anos, fue cambiado a un mandato de cuatro anos por la Legislatura durante la sesi6n de 1999. Vease Acts, 1999, 76 Leg., Ch. 691 (C6digo Gubernamental de Texas, Sec. 30.00044). Se utilizard en estas elecciones un sistema electr6nico de votaci6n, incluyendo la votaci6n anticipada. Dichas Elecciones Municipales Generales se celebraran en la Ciudad de Lubbock en los lugares designados mas adelante como distritos electorales y en los centros electorales designados en la Prueba A adjunta. Los centros electorales permanecerdn abiertos desde las 7:00 de la manana hasta las 7:00 de la noche , y todos los electores votardn en el distrito correspondiente a su lugar de residencia, a menos que dicho distrito haya quedado consolidado con otro distrito como se establece en la Prueba A adjunta a este documento. En estas Elecciones Municipales Generales se utilizara el procedimiento de cajas electorales selladas establecido en el Subcapitulo C, Capitulo 127 del C6digo Electoral de Texas. Las personas nombradas mds adelante en la Prueba A quedan mediante este documento designadas como Jueces y Jueces Suplentes para llevar a Cabo las Elecciones Municipales Generales el 6 de mayo de 2000. Cada uno de los jueces presidentes asi nombrado esta autorizado para nombrar un numero de secretarios autorizados por el Administrador Electoral. Dicho numero no sera inferior a dos (2) secretarios, ni superior a seis (6). Los jueces suplentes ejerceran como jueces presidentes en el caso de que el juez presidente nombrado no pueda ejercer dicha funci6n. El juez suplente sera nombrado por el juez presidente para servir como secretario en el caso de que la elecci6n la lleve a cabo el juez presidente nombrado. La votaci6n anticipada en persona comenzara el dia 19 de abril de 2000, y terminara el dia 2 de mayo de 2000. Dicha votaci6n anticipada se llevara a cabo en los lugares, dias y horas indicados en la Prueba B adjunta. AVISO DE ELECCION Mediante el presente documento se ordena a la Secretaria Municipal de la Ciudad de Lubbock la publicaci6n de estas Elecciones Municipales Generales mediante la publicacion de esta Orden y Aviso de Elecciones Municipales Generales en un peri6dico de circulaci6n general al menos una vez en fecha no anterior a 30 dias ni posterior a 10 dias antes del dia de las elecciones. Ademas, una copia de esta Orden y Aviso de Elecciones Municipales Generales sera anunciada en fecha no posterior a 21 dias antes del dia de las elecciones, en el tablero de anuncios utilizado para la colocaci6n de avisos de reuniones del cuerpo directivo y un aviso de consolidaci6n quedard anunciado al menos 20 dias antes del dia de las elecciones en los centros electorales no consolidados en la ultima elecci6n. Dicho anuncio indicara la consolidacion de distrito y el lugar del nuevo centro electoral. La Secretaria Municipal presentard una copia debidamente certificada de esta Orden de Elecciones y Aviso de Elecciones Municipales Generales a cada uno de los Jueces Presidentes nombrados en la Prueba A adjunta a este documento, en los siete dias siguientes a la fecha de la firma de esta Orden y Aviso de Elecciones o 15 dias antes de las elecciones, to que se produzca mas tarde.
