HomeMy WebLinkAboutOrdinance - 2001-O0013 - Amending Chapter 8 - 02/08/2001First Reading January 25, 2001 Item No. 50 Second Reading February 8, 2001 Item No. 17 ORDINANCE NO. 2001-00013 AN ORDINANCE AMENDING CHAPTER 8 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, TO CHANGE THE VOTING PLACE FOR VOTING PRECINCT NO. 23 FROM MONTEREY HIGH SCHOOL TO LUBBOCKVIEW CHRISTIAN CHURCH; ESTABLISHING A PERMANENT POLLING PLACE FOR VOTING PRECINCT NO. 11 l; CORRECTING A CLERICAL ERROR IN THE DESCRIPTION OF VOTING PRECINCT NO. 11 l; PROVIDING FOR JOINT USE OF EARLY VOTING LOCATIONS WHEN PRACTICAL AND LEGAL TO DO SO; PROVIDING THAT ALL PORTIONS OF CHAPTER 8 NOT AMENDED SHALL REMAIN THE SAME; DIRECTING THAT THE OFFICIAL MAP BE AMENDED TO REFLECT THIS CHANGE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a petition requesting that the polling place for City of Lubbock Voting Precinct No. 23 be moved from Monterey High School to Lubbockview Christian Church for the benefit of the voters of said Precinct has been heretofore filed with the City of Lubbock; and WHEREAS, the City Council has heretofore appointed a Temporary Election Committee to study and recommend ways in which City, County and Lubbock Independent School District polling places can be unified in order to reduce voter confusion as to locations of election hosted by the various governments; and WHEREAS, said Committee has recommended that the voting place for Precinct No. 23 be moved from Monterey High School to Lubbockview Christian Church because of parking and other problems that make Monterey High School impracticable to use and emergency requirements that make the fire station located within Precinct 23 impracticable to use; and WHEREAS, said Committee also has recommended that the voting place for Precinct No. 111 be changed from consolidation with the nearest permanent polling place to a permanent location at the County owned building located at 7402 82" d Street, which change will have the effect of requiring Precinct Nos. 104 and 112 to be consolidated with No. 111 temporarily, which will match the County's practice at that location; and WHEREAS, said Committee also recommended that branch early voting locations be shared with regard to locations and hours by all entities to the extent practical and permitted by law (three locations presently are used by both the City and the County); and WHEREAS, this Ordinance also serves to correct a clerical error discovered in the metes and bounds description of Precinct No. 111; and WHEREAS, the City Council finds it to be in the public interest of the citizens of the City of Lubbock to move the polling places as requested by the Committee and correct the clerical error in the description of Precinct 111; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT subsection 8-4(a) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows with regard to the following named voting precincts: Voting Precinct No. 23. Beginning at the intersection of 341h Street and Gary Avenue; thence south along Gary Avenue to its intersection with 50`h Street; thence west along 50" Street to its intersection with Knoxville Avenue; thence north along Knoxville Avenue to its intersection with 34th Street; thence east along 34th Street to the point of beginning. The voting place shall be Lubbockview Christian Church, 3301 34`h Street. Voting Precinct No. 111. Beginning at the intersection of 98`h Street and Slide Road; thence south along Slide Road to a point 660 feet south of the centerline of 114`h Street; thence west along a line (the city limits) parallel to and 660 feet south of the centerline of 114t' Street to a point 660 feet south and 55 feet west of the intersection of the centerlines of 1141h Street and Alcove Avenue; thence north along a line (the city limits) 55 feet west and parallel to the centerline of Alcove Avenue to its intersection with the north right-of-way line of U.S. Highway 62; thence northeasterly along the north right-of-way line of U.S. Highway 62 (the city limits) to its intersection with Upland Avenue; thence south along Upland Avenue to its intersection with 82n1 Street; thence east along 82nd Street to its intersection with Milwaukee Avenue; thence south along Milwaukee Avenue to its intersection with 98`1 Street; thence east along 98th Street to the point of beginning. The voting place shall be the County Building located at 7402 82n1 Street. SECTION 2. THAT the City of Lubbock official map of election precincts and polling places be amended to reflect this change and subsection 8-4(c) of the Code of ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (c) The voting districts, voting precincts and voting places set out in this section shall be delineated on a map denominated "City of Lubbock Voting Precincts/Districts, effective Fe , g q (date of final passage by the City Council), 200 1 /Official Map." A copy of said map shall be attached to and made a part of this Ordinance as if fully copied herein in detail. A copy of the original of such map shall be kept in the office of the City Secretary and shall be available for public inspection, and at each special and general city election, a true copy of said map shall be furnished by the City Secretary to each of the presiding judges of the voting precincts for such special or general city election. SECTION 3. THAT in every case where it is practical and legal to do so, branch early voting locations shall be utilized jointly utilized by the City, County and LISD. SECTION 4. THAT all portions of Chapter 8 of the Code of Ordinances of the City of Lubbock not specifically amended by this ordinance shall be and remain the same. 2 SECTION 5. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 6. THAT the City Secretary is hereby authorized and directed to cause publication of this Ordinance in its entirety following final passage by the City Council. SECTION 7. THAT this Ordinance shall be effective upon final passage but shall not be enforced until such time as all legal requirements pertaining to approval of changes in polling places under state and federal law are met and approval is received.
