RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock,Amendment No.1to Contract No.13098 for engineering
services related to 98th Street design and construction,by and between the City of Lubbock and
Kimley-Horn and Associates,Inc.,of Lubbock, Texas, and related documents. Said Contract is
attached hereto and incorporated in this Resolution as if fully set forth herein and shall be
included in the minutes of the City Council.

Kimley-Horn and Associates, Inc.
THIS IS THE FIRST AMENDMENT TO THE AGREEMENT dated and entered into the 15' day of
December 2016 by and between the City of Lubbock ("City") and Kimley-Horn and Associates, Inc.
("Kimley-Horn"), a North Carolina Corporation, for providing engineering services for the design and
construction of paving 98th Street between Upland Avenue to Milwaukee Avenue ("Project").
WITNESSETH:
WHEREAS, the City desires to increase the scope of the work to be performed by Kimley-Horn on the
Project. The new scope shall include: the design and construction documents for a 50-foot wide parallel
drainage channel on the south side from Upland Avenue to Quincy Avenue, a 12-inch water line
relocation, culverts beneath the Rochester Avenue and Quincy Avenue roadway connections to the south,
and all associated hydraulic modeling and right-of-way coordination, survey, and document preparation.
The details of work to be performed and associated additional fees are described in Attachment A and
Attachment B respectively, attached to and incorporated herein.
WHEREAS, all other portions of the original Agreement and previous Amendments, if any, shall remain
in place and are not altered by this amendment.
NOW, THEREFORE, the City and Kimley-Horn agree to the terms of this FIRST AMENDMENT:
IN WITNESS HEREOF, the parties have executed this Agreement as of this 26th day of October
2017.

Amendment #1
Project Understanding
The original scope included "the design and construction documents for 98th Street from Upland Avenue to
Milwaukee Avenue. 98'h Street will be improved from a 2-lane dirt roadway to a three -lane all-weather surface
(asphalt and/or concrete)."
This amendment adds new scope that was not included in the original agreement. New work includes: design
and construction documents of a 50'-wide parallel drainage channel on the south side of 981h Street from
Upland Avenue to Quincy Avenue, 12" water line relocation from Upland Avenue to Quincy Avenue, culverts
beneath the Rochester Avenue and Quincy Avenue roadway connections to the south, and all associated
additional hydraulic modeling, coordination for additional ROW and easements, survey and document
preparation for same.
The new scope added by this amendment is detailed below. Original scope items not mentioned remain
unchanged and will be performed by the Engineer as per the original agreement:

1.3.1 Schedule, prepare for, attend, and document additional Progress and Review meetings;
three (3) meetings
1.5. Modify and maintain project schedule, accounting for additional scope items, adjustments in task
timeframes and milestone dates.
1.6. Project Administration
1.6.1 Prepare additional monthly invoices and reports
1.6.2 Prepare additional project correspondence and process invoicing documents
1.8. Additional Coordination with sub -consultants (ROW, drainage, SUE)
1.9. Low cost alternatives sensitivity analysis
1.9.1 Prepare modified roadway plan limits, design profiles, drainage elements, earthwork
quantities and all associated cost estimates to optimize design within original budget
2. Survey - No Change
3. Right -of -Way
3.6. Survey additional ROW, drainage, and slope easements (maximum 11 additional parcels)
4. Subsurface Utility Engineering (SUE) (by Subconsultant)
4.2. Utility investigations, both subsurface and above ground, will be prepared in accordance with ASCE
C-1 38-02 and according to the Utility Quality Levels as described below. Utility Quality Levels are
defined in cumulative order (least to greatest) as follows:
4.2.4 Quality Level A - Additional field work and coordination due to addition of the parallel
channel

6. Franchise Utility Coordination (K-H)
6.1. Preliminary Design Coordination:
6.1.3 Franchise Conflicts Evaluation
• Coordinate with design team regarding additional potential conflicts
6.2. Final Design Coordination:
6.2.1 Additional coordination due to drainage channel and Xcel substation
6.2.2 Additional coordination with SPEC related to their proposed future transmission lines
7. Drainage (by Subconsultant and K-H)
7.2. Modeling
7.2.5 Design of ultimate and interim conditions H&H modeling
7.3. Plan Production
7.3.3 Provide summary sheets showing necessary hydrologic and hydraulic calculations and
assumptions for design and prospective fully developed roadway and additional
calculations for the interim conditions.
7.3.5 Prepare two (2) additional Culvert Layout plan and profile sheets; one each for Rochester
Avenue and Quincy Avenue
7.3.6 Provide additional culvert details to support the design intent for additional work
8. Roadway Design (K-H)
8.2. Prepare the roadway horizontal alignment between Upland Avenue and Milwaukee Avenue
including the transition from '/z T2 section on the north side of 981h Street to a 2-lane section
centered on the section line.
8.3. Prepare additional roadway typical sections for alternatives
8.5. Develop design cross-sections/Models
8.5.1 Develop multiple corridor models and cross sections for multiple interim alternatives and
one (1) final alternative
8.6. Prepare additional roadway details to clarify intent of design
8.11. Prepare intersection layouts for Rochester Avenue and Quincy Avenue.
8.12. Prepare plans and details for concrete block retaining wall in select locations between Upland
Avenue and Quincy Avenue
9. Bidding Phase - No Change
10. Construction Phase Services (Engineer of Record) - No Change
11. Water Line Design (K-H) - NEW TASK
11.1. Prepare water line relocation plans between Upland Avenue and Quincy Avenue

Kimley-Horn will perform the additional services in the above tasks for the total lump sum fee shown above, inclusive of expenses.
Individual task amounts are informational only. Kimley-Horn reserves the right to reallocate amounts among tasks as necessary. All
permitting, application and similar project fees will be paid directly by the Client. Lump Sum fees will be invoiced monthly based on the
overall percentage of services performed.
