Such improvements in each Unit or District shall be paid for in the following man- ner: (a) Railwuys End street railways using, occupying, or crossing any portion of said streets and avenues to be improved shall pay fro and be assessed fro all the cost of work in the area between their rails and tracks, double tracks, turnouts, and switches, and two feet on each side thereof. (1a) The abutting property and owners thereof shall pay and shall be assessed for all the cost of conotrueting curbs in front of such respective properties, ani 90✓a of the remaining cost of such improvements, after deducting the sums to be paid by railways and street railways under sub -paragraph (a) above, "provided that if it shall appear at the hearing to be had before final assessment that the special benefits to such property in the enhanced value thereof by means of such improvements will not aggregate such proportions of costs, then there shall be assessed and be paid by such abutting property, and the owners thereof, the amount of such benefits. (e) The remaining cost of oftid improvements, after deducting the sums finally as - sensed against railways and street railways under sub -paragraph (a) hbreog,:t3nd'aeainst abttti.pg,propbriyadnai-the burners thereof under sub -paragraph (b) above, shall be paid by the City of Lubbock. V. The amounts to be paid by and assessed against railways and street railways for work between rails and tracks and two feet on each side thereof, shall be payable on estimates as the work progresses, as may be provided in such specifications, and shall bear int- erest from date due and until paid at the rate of Jp per ahhum. The amounts to be as- sessed against and paid by abutting property and the owners thereof in each Unit shall be payable in six equal installments, due respectively on or before 7O days, 1,2,3,4, and 5 years after the completion and acceptance by the city of the improvements in the Unit upon which the property abuts, and shall bear interest from date of such comple- tion and acceptance and until paid at the rate of fo per annum, payable annually, with provision that if de&ault be made in the payment of any installment promptly as the same matures, then at the option of the holder of any ouch assessment, or certificate issued in evidence thereof, such default shall mature the entire assessment upon which same is made. Vi. Assessments shall be made and levidd and shall be a first and prior lien and personal liability for princixai, interest, reasonable attorney's fees and costs of collection, if incurred, all under and in accordance Voith the Charter, and amendments thereto, now in force in this City. LUBBOCK NEW FORM NO. 3.v RESOLUTION ADOPTING PLAITS AND SPECIFICATIONS AND DIRECTING ADVERTISE1,1ENT FOR BIDS. , WHEREAS, the City Commission of the City of Lubbock has passed a rsolution ordering that portions of 'texas Avenue, and sundry other streets and avenues, embracing Units Nos. 1 to 10 inclusive, be improved by raising, grading, and filling, and paving, and otherwise, and directing preparation of plans and specifications therefor; and, WHEREAS, the City Engineer has prepared and tiled with the City plans and specifications for such improvements, and same have been examihed and epproved: THER32OF3, BE IT RESOLVED BY TE13 CITY OF LUBBOCK, TEXAS: I. That said plans and specifications be and the same are hereby adopted and approved. II. That the City Clerk be and he'is hereby directed to advertise for bids for the making and construction of such improvements, such advertisements to be published at least two times in a newspaper published in and generally circulated in the City of Lubbock, Texas, and the first of said advertisements shall be published at least five days before the date for receiving and opening bids. f< z This resolution ahall take effect and be in force from and after its paseaae. Motion made by Mr. Hankins, seconded by Lir. leaver, carried unanimously that the petition fro underground passage on Avenue H be filed and further action postponed until Lir. J.F. Anton is arable to attend at this time. Motion made by Mr. Weaver, seconded by Mr. Hankins, carried unanimously that the City Commission be adjourned in r1ular session. READ AND APPROVED this OU day of December, A.D., 1026. MAYOR2 AT" 1rm City Secretary. December 23, 1926. City Commission met in regular session at one P.M. with the following present: Mayor Pink L. Parrish, Commissioners W.S. Posey and A.V. leaver, City Attorney N.L. Klett, Superintendent of Utilities N.H. Perkinson and Secretary F.W. 3roce. absent: Commissioners J.H.Hankins and J.O.Jones. The minutes of December 9 were read and upon motion made by Mr. nosey, seconded by Ir. 'Weaver, they were unanimously approved. The minutes of accounts allowed from Tarrant No. 6378 to 6548 were gone over and upon motion made by lur. 'Weaver, seconded by 11r. Posey, they were approved and ordered signed by the Mayor and Secretary. Motion made by Lir. leaver, seconded by Lr. Posey, carried unanimously that J.F. Anton be notified by letter to come before the Commissioners at their next regular meeting, January 13th, to discuss the Santa Fe Railway water rates and the underground passage on avenue H, also to send a copy of the letter to noscoe dilson, J.E. Vick- ers and R.F. Bayless. Motion made by Mr. nosey, seconded by Lir. leaver, carried unanimously that L.F. McKinley's Plumbers Bond in the amount of $3000.00 be approved and filed. Motion made by 1r. leaver, seconded by Mr. Posey, carried unanimously that John Conner be paid 46.00, being for six months sewer paid at 2002 Avenue sue when there was no sewer connection at that time. Motion made by Mr. nosey, seconded by Mr. 'Weaver, carried unanimously that we pay Louie F. Moore Court Costs in the amount of $8.45 being for suit No. 2006, City of Lubbock vs. R.L. -Wilkinson. The bills of Aetna Life for compensation insurance for August, September, and November and suit against the Suriek Insurance Company were passed up. Motion made by Mr. losey, seconded by Mr. Weaver, carried unanimously that City Attorney, E.L. Klett, be instructed to write Al. A. Izard regarding the non-payment of his franchise tax of $25.00 and his bond in the amount of $10,000.00 not being filed. Motion made by Mr. nosey, seconded by Mr. leaver, carried unanimously that T.J. Morgan be fefunded $25.00 being for license fee paid January 7th which later on in the month was revoked. Motion made by Lir. .Weaver, seconded by Lir. Fosey, carried unanimously that the following purchase agreement be entered into and signed: 0
