November 24,1926.
City Commission met in called session at to A.M. for the purpose of granting A.J.McMahan
and Associates extension of time on ',as Franchise and purchasing 61 Acres of land Forth- 4r
east of town and selling of lots 3 and 4 in Block 127 with the following present:
Mayor Pink L. Parrish, Commissioners I.S. Posey, J.O.Jones and A.V. :leaver, attorney
3.L.13ett, Superintendent of Utilities W. H. Perkinson, Secretary ?.,9. Grace.
Absent: J.H. Hankins.
Motion made by lir. Posey, seconded by Lir. Jones, carried unanimously that the followin
resolution be passed and signed by Mayor and City Secretary:

MAINS AND DISTRIBUTING SYSTEM UiiDER FRANCHIS3
GRANTED A.J. MCMAHAN AND ASSOCIATES:
WHEREAS heretofore, to -wit, on or about the 17 day of June A.D. 1926, the City
Commission of the City of Lubbock, Texas, granted to A.J. McMahan and associates a franchise
for the construction of a system of pipe lines for the sale and distribution of natural
gas to the citizens of the pity of Lubbock, and
WHEREAS, in said ordinance by Section 13 thereof it was provided that such distri-
bution systems should be completed and the said A.J. WcMahan and his associates, or
assigns, should be prepared to serve gas to consumers in the amity of Lubbock by January
lst, 1927; and
MHERE,AS, owing to the inability of the said A.J. UcMahan and his associates to
secure deliveries of pipe necessary to the completion of their said pipe line and dis-
tribution systems they are unable to complete said system by January lat. 1927, as pro-
vided in said ordinance granting said franchise; and
HHEREAS, said delay has been occasioned by causes beyond the control of the said
A.J. McMahan and his associates:
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Lubbock. Texas,
that the said A.J. McaLahan, George i Broadwell and :t.A. Tipton, be and they are hereby
granted an extension of ninety days from and after the first day of January, A.D.,1927, with
in which to complete their said distribution system in the City of Lubbock, Texas, and
to be prepared to serve gas to consumers in the City of Lubbock, Texas.
And upon motion of Commissioner N.S. Posey, seconded by Commissioner J.O.Jones, it
was moved before the said City Commission of the City of Lubbock that said resolution be
passed, and said motion having been put Commissioners nosey, Jones+ leaver, and mayor
Parrish voted in favor of the passage and adoption of said resolution, and the said
motion was thereupon declared to have carried and the said resolution in all things duly
adopted.

Motion made by Mr. Jones, seconded by Mr. Posey, carried unanimously that the City pur-
chase from S. 14. Jackson the sixty-one(61) acres Northeast of City, and pay therefor
49500.00 as follows: 44000.00 cash out of the City Park Fund, assume balance of 53000.00
on said 61 acres and execute time warrants in equal amounts due one and two years, six
(6%) per cent interest, and as an additional consideration a deed to Lots 3 and 4, Block 127
of the Overton riddition to the town of Lubbock in Lubbock County, Texas, to be conveyed by
the City by and through Pink L. Parrish, Mayor, and F.W. Grace, Secretary, to said S.N.
Jackson.
FURTHER ordered that City Attorney E.L.Xlett pass on the title to abstract and deed
to said 61 acres.
