It was moved by Yr. Blair and seconded b7 Mr. WolTfarth that the followifig
resolution be read.

The Southwestern Bell Telephone Company represents to tae "it7
of Lubbock that the rates now crargec and the rates to be charged for Tele-
ih-ne service during the present Tear will not _7ield to the said South-
western Bell Telephone Company a fair return upon the fair value of its
property used and useful in furnishing telephone service in the City of
Lubbock and,
+WH 21S, the Southwestern Bell Telephone Comz3ny proposed to the City
Commission of the City of Lubbock to take immediate steps to erect a modern
and up-to-date building, install in said building new and modern switch-
board equipment, and largel7 increase its distributing plant, consisting of
under --round facilities in the burliness district and serial cable in the
res-

idence district, the said improvements estimated at a gross cost to the
Comiany in excess of P250,000.00 provided upon the completion of the proposed
improvements the Citv Commissionof the City -of Lubbock, Texas, will not oppose
t.e establishment of such rates for telephone service in the City of Lubbock
as will -yield the Southwestern Bell Telephone Company a fair and reasonable
return.
NOW i''d.&z.EFO:i_E, be it resolbed -hat the Cit- Commission of the Citv of Lubbock
Texas, recognizes the right of the Southwestern Bell Telephone Company, upon
the completion of the improvements aforesaid, to charge such rates for telephone
service in the Citv of Lubbock as will produce a fair return- upon the fair
value of its telephone exchange propert7 then_ used in rendering telephone
service in the said City.
Be it farther resolved tnat upon the completion of the work aforesaid, the
Telerho-.e Comran7 shall file wits the City Commission its schedule of rates,
such as will produce a fair return upon the fair value of its said propert7
used in renderin telephone service in its Lubbock Exchange and sho-jld the
Commission desire to make any inve-•-tigation with respect to said schedule of
rates, it spall co_r Tete its investigation and notify the Telephone C -�rany
of its conclusidn within ninety da7s from the filling of said schedule. For
the purpose of aiding the City Commission in making such investigation, the
Telephone Company shall file with the City Commission statements showing in
detail t=e value of its propert7 in the Lubbock Exchange, the estimate amount of
revenue to be received from operating_ said exchange, and the estimated amount
in detail of its operating expenses, to enable it to complete its investigation
aforesaid, and shall furnish and exhibit of the previous Tears buiiness, dompany
shall file no action within the time limit.
Provided further that the vitt/ Commission reserves to itself all of its lawful
riehts to inquire into and regulate telephone rates at any anO all times.
This shall not be construed to confer on the Company any rights except noted,
not former17 possessed.
