Jones, seconded by ::r. nosey, carried that Hawley & Roberts be paid their statement of $679.82 as follows: - from the water bond account "'503.96 and from the sewer bond account $175.86. A motion by L:r. Jones, seconded by Kr. Hankins, carried that the matter of alley paving to be paid for by property owners according to the City's specifications be tabled. petition that lights be placed in the alleys was read by the L:ayor, upon which a motion by Yr. Done::, seconded by Mr. F(L ey, prevailed that the +� matter be tabled. City M,n ager Davis was instructed to write the _71gin Street Sweeper Company that the warrant previously issued them would be paid just as soon as possible. RESOLUTION It appearing to the Commission after investization and upon consultation with Harry N. Roberts that there is of record, in Volumeag �, r e of the Y.inutes of the City Commission a contract purForting to ave been executed on the part of the Cith with Hawley & Roberts, as City Engineers, employing the said firm to design and supervise the construction of sewer, water and paving, and the Commission finding that the City did not enza7e said firm to superintend the paving or promise them She fee therefor, or -authorize any one to enter into a contract with regard thereto, and it- further t-further appearing that the Commission did not know such contract was of record until recently, and that there was no authority therefor, the Commission here and now declares that upon a motion by Mr. Blair, seconded by Mr. Jones, carried unanimously that said purported contract was not entered into and riot bin*ing and the Commission hereby cancels and annuls said record and purported contract, and orders same stricken from the records. Motion by Lr. Hankins,seeonded by 1r..osey prevailed that: - Be it hereby ordered th4t no light, power, water, sewer, service, material or other thing of value be furnished -directly or indirectly, by the City to any person, firm, corporation, or official or employee of the City, except at the same rate and upon the same terms as furnished to others. April 27, 1926, with the following present: - Mayor rink L. Farrish, Commissioners J.O. Jones, F..a. Blair, d.5. "nosey, J.H. Hankins, Attorney R.L. ylett, and r.F. Davis, City ;manager. 8ity L'4nager :alis made the following statement: - "While I want to sincerlay thank the Commission and thank them for the complement they have paid me in offering me the position of City T'anaer, I have definitely made up my mind that I can best serve Lubbock by devoting all Of my time to the Chamber of Commerce and its allied Organizations,- the Fair Association and the Retail-erchants Association. ?or this rerson I want to ask that the Commission accept my resignation, filed April 8th and to furthet ask that they have a supplementary audit of the books made do -,,.,n to the time I go out of office." After this statement a motion by Lir. Posey, seconded by Mr. Blair,prevailed that City L16na?er Davis' resignation be accepted with regrets, that the auditors " be authorized to brim their audit down to the date of i,:r. Davis' eoing out of office and that the Commission express appreciation to Mr. Davis for his services. A motion by Lr.
