That the improvements on said portions of Avenue X and Sixteenth Street, be and the same are hereby accepted. 11. That the Mayor and City Secretary be and they are hereby instruct- ed to execute and deliver to the Contractor certificates in evidence of the assessments levied against the parcels of property abutting upon the said portions of Avenue X and Sixteenth Street, and against the owners of such property in the manner provided in said contract, and the proceedings with reference to said improvements and assessments. 111. That the said bond, together with the surety thereon. be and the same is hereby in all respects accepted and approved. 1V. Jackson be paid $160.00 for a strip of land twenty feet wide off of the North side of his property in Block 19, in Overton Addition to the City of Lubbock, it being un- derstood that Mr. Jackson will apply said sum on back taxes he is due the City of Lubbock. Public necessity exists that the following portions of streets and avenues it. the City of Lubbock, Texas. be improved as herein provided, to -wit: NINETEENTH STREET, from the center line of the intersection of Avenue M to the center of the 'intersection of Avenue N, from the South, known and designated as District or U1,it ito. 13. AVENUE N, from its intersection with the 1`orth line of Twenty -Third Street to the center of the into section of Nineteenth Street from the East. known and designated as District or Unit No. 14. EL TIANO AVENJ::, from its intersection with the South curb line of Nineteenth Street to its intersection with the South property line of Twenty -First Street, known and designated as District or Unit No. 15. 1 AVENUE J, from its intersection with the North property line of Tenth Street to its intersection with the North property line of Ninth Street, known and designated as District or Unit No. 16, AVENUEE J, from its intersection with the North property line of Ninth Street to its intersection with the North property line of Fifth Street, known and desixnated as District or Unit No. 17. AVENUE J, from its intersection with the North property line of Fifth Street to its intersection with the South property line of Fourth Street, known and designated as District or Unit No. 18. 11. Said portions of streets and avenues shall be improved by raising, grading, and filling same, and by installing concrete curbs and Butters, and storm sewers and drains where necessary, and by paving with one of the following types of material on proper foundation, to -wit: (a) Vertical Fibre Brick (b) Rock Asphalt (c) Warrenite Bitulithic (d) Concrete (e) Asphaltic Concrete (f) Patented Types of Paving, the exact type of pavement to be determined by the Commission of the City of Lubbock after receipt of bias. 111. The City&gineer is hereby directed to prepare plans and spe- cifications for such improvements embracing specifications for each of the said types of paving. 1V. Such improvements in each Unit or District shall be paid for in the following manner: (a) Railways and street railways using, occupying, or cross- ing any portion of said streets and avenues to be improved shall pay �for and be assessed for all the cost of work in the area between their rails and tracks, double tracks, turnouts, and switches, and two feet on each side thereof. (b) The abutting property and owners thereof shall pay and shall be assessed for all the cost of constructing curbs in front of respective properties, and 90;0 of the remaining cost of such improve- ments, after deducting the sums to be paid by railways and street rail- ways under sub -paragraph (a) above, provided that if it shall appear at the hearing to be had before final assessment that the special ben- efits to such property in the enhanced value thereof by means of such improvements will not aggregate such proportion of costs, then there Zshall be assessed and be paid by such abutting property, and the own - s thereof, the amount of such benefits. (c) The remaining cost of said improvements. after deducting e sums finally assessed against railways and street railways under b -paragraph (a) hereof, and against abutting property and the own- s thereof under sub -paragraph (b) above, shall be paid by the City Lubbock. V. The amounts to be paid by and assessed against railways and street railways for work between rails and tracks and two feet on each side thereof, shall be payable on estimates as the work progresses, as may e provided in such specifications, and shall bear interest from date due and until paid at the rate of 7a per annum. The amounts to be as - eased against and paid by abutting property and the owners thereof in each Unit shall be payable in six equal installments, due respectively on or before 10 days, 19 2, 3, 4, and 5 years after the completion and ' cceptance by the City of the improvements in the Unit upon which the roperty abuts, and shall bear interest from date of such completion and cceptance and until paid at the rate of 7ya per annum, payable annually, ith provision that if default be made in the payment of any installment promptly as the same matures, then at the option of the holder of any such assessment, or certificate issued in evidence thereof, such de- fault shall mature the entire assessment upon which same is made. n8 v Ordinance No. 386 re- pealed. Assessments shall be made and levied and shall be a first and pri- or lien and personal liability for principal, interest, reasonable at- torney's fees and costs of collection, if incurred, all under and in t accordance with the Charter, and amendments thereto, now in force in this City. 711. The City Commission of the City of Lubbock, Texas met at the regular meeting place in the City "all at 1:30 Y. M. in regular session re- cessed from August 11, 1927, the following members thereof being pres- ent, to wit: Mayor Pink L. Parrish, Commissioners J. H. Hankins. W. S. Posey, J. 0. Jones and A. V. 'Weaver, City Attorney E. L. Klett, City Manager W. H. Perkinson, and City Secretary G. W. McCleary. Minutes of Regular Meeting July 28, 1927 and of Recessed Regular Meet- ings of August 1 and 5, 1927 were read and upon motion made by Lir. Hankins, seconded by Lir. ,heaver, they were unanimously approved. (Ordinance No. 386, closing that portion of Fourth Street between the Santa Fe Railroad Right of Nay and Avenue I, was passed to be effective when the Nest Texas Compress Company pays the City X550.00 as a consid- eration for the closing of said portion of said street, and as said suQ had not been paid August 27, 1927, the City Commission repealed said Or- dinance and ordered that same be left off the record and instructed that Mr. T. M. Nowlin, Manager of the West Texas Compress Co., be re- quested to return to the City the copy of said Ordinance delivered to him by the City Secretary through error, the Secretary being out of the room at the timethe agreement was made that the .550.00 would be paid as stated above.) There was offered for consideration and passage by the City Commission an Ordinance entitled: AN ORDINANCE CONSOLIDATING THE' OFFICES OF CITY SECRETARY AND CITY TREASURER; AND DECTA.RING AN EMERGENCY. Said Ordinance was read in full by the City Secretary and upon motion made by Mr. Posey, seconded by Lir.
