TH&-L, Public necessity exists thattthe following portions of street, avenues and alleys in the City of Lubbock, Texas, be improved, as herein provided, to -wit: Paving ivenue u, from its intersection with the North property line of 19th street to its intersection with the North property line of 26th street, 50 feet wide. II. Said portions of streets, Avenues and alleys shall be improved by raising, grading and filling same, and by installing concrete curbs and gutters, and storm sewers and drains where necessary, and by paving with one of the following types of material on proper foundation, to -wit: (a) Vertical Fibre Brick. (b) Rock Asphalt. (c) 71arrentie Bitulithic. (d) Concrete. (e) Asphaltic Concrete. (f) Patented Types of Paving. The exact type of pavement to be detertiined by the Commission of the City of Lubbock after receii)t of bids. III. The City Engineer is hereby directed to' -prepare plans and specifications for such improvements embracing specifications for each of the said types of paving. IV. Such improvements in each Unit or District shall be paid for in the followine manner. (a) Railways and stroei railways using, occupying, or crossing any portion of said streets, or avenues to be improved, shall pay for and be assessed for all the cost of work in the area between their rails and tracks, double tracks, turnouts, and switches, and trio feet on each side thereof. Elements. The ;Minutes of Ilegular l.eeting of 1.`ay 22, 1930, and Recessed Regular 1:eeting of May 28, 1930, were read and upon motion by 11r.Benson, seconded by Mr. Bacon, they were unanimously approved. -otion by Er. (b) the abutting property and owners thereof shall pay and shall be assessed for all the cost of constructing curbs in front of such respective properties, and 9096 of the remaining ' cost of such improvements, after deduction the sums to be Daid by railways and street railways under sub -paragraph (a) above, provided that if it shall appear at the hearing to be had before final assessment that the special benefits to such property the enhanced value thereof by means of such improvements will not aggregate such proportion of costs, then there shall be assessed and will be paid by such abutting property, the owners thereof, -.he amount of such benefits. (e) The remaining cost of such improvements after deducting the sums finally assessed against railways and street railways under sul-paragraph (a) hereof, and against abutting 'a operty and the o„niers thereof under sub -paragraph (b) above, shall be paid by the City of Lubbock. V. The amounts to be paid by and assessed against railways and street railways for work between rails and tracks and two feet on each side thereof, shall be payahle on estimates as the work vrogresses, as may be provided in such specifications, and shall bear interest ' fro,m date due and until paid at the rate of 79' per annum. The amounts to be assessed against and paid by abutting property and the otimers thereof in each unit shall be payable in six equal install- ments, due respectively on or before 1� days, 1,2,3,4, and 5 years after the completion and acceptance by the City of the improvements in the unit upon wi.ich the property abuts, and shall bear interest from date of such completion and acceptance and until raid at the rate of 7cil, per annum, payable annually, with provision that if default be made in the payment of any installment promptly as the same matures, then at the option of the holder of any such assessment or certificate issued in evidence thereof, such default shall mature the entire assessment upon which same is made. VI. Assessments shall be made and levied and shall Ite a first an prior lien and personal liability for principal, interest, reasonable attorney's fees and costs of collection, if incurred, all under and in accordance with the Charter, and amnendments thereto, now in force in this Uity. RESOLUTION ADOPTING PLANS AND SPECIFIC.TIONS AND DIRECTING ADVERTISEMENT FOR BIDS. 7 .RE the City Commission of the City of Lubbock has passed a resolution ordering that a portion of Avenue H, from its intersection with the Lorth property line of 19th Street, to its intersection with , the North property line of 26th street, known and designated as Unit or District No. 37, be i.iproved by raising, grading ani filling, pavin, and otherwise, and directing preparation of plans and specifications therefor;
