(b) the abutting property and owners thereof shall pay
and shall be assessed for all the cost of constructing curbs in
front of such respective properties, and 90% of the remaining
cost of such improvements, after deduction the sums to be paid
by railways and street railways under sub -paragraph (a) above,
provided that if it shall appear at the hearing to be had before
final assessment that the special benefits to such property
the enhanced value thereof by means of such irprovements will n^t
aggregate such proportion of costs, then there shall be assessed
and will be paid by such abutting Droperty, the owners thereof,
:he amount of such benefits.
(e) The remaining cost of such improvements after deducting
the sums finally assessed against railways and street railways
under sub -paragraph (a) hereof, and against abutting property and
the owners thereof under sub -paragraph (b) above, shall be paid
by the City of Lubbock.
V.
The amounts to be paid by and assessed against railways and street
railways for work between rails and tracks and two feet on each
side thereof, shall be payable on estimates as the work progresses,
as may be provided in such specifications, and shall bear interest
fr= date due and until paid at the rate of 74 per annum. The
amounts to be assessed against and paid by abutting property and the
owners thereof in each unit shall be payable in six equal install-
ments, due respectively on or before li; days, 1,2,3,4, and 5 years
after the completion and acceptance by the Uity of the improvenents
in the unit upon which the property abuts, and shall bear interest
from date of such completion and acceptance and until paid at the
rate of 70,, per annum, payable annually, with provision that if default
be made in the payment of any installment promptly as the same
matures, then at the option of the holder of any such assessment
or certificate issued in evidence thereof, such default shall mature
the entire assessment upon which same is made.
VI.
Assessments shall be made and levied and shall be a first an prior
lien and personal liability for principal, interest, reasonable
attorney's fees and costs of collection, if incurred, all under
and in accordance with the Charter, and ammendments thereto, now
in force in this City.
VII.
This resolution shall take effect and be in force from and after its
passage.

AND DIRECTING ADVERTISET.T:NT FOR BIDS.
REAS, the City Commission of the City of Lubbock has passed a
resolution orderinE that a portion of Avenue H, from its intersection
with the Borth property line of 19th Street, to its intersection with
the North property lire of 26th street, known and designated as
Unit or District PTO. 37, be i .proved by raising, grading aid fiilinr,
pavan_ and otherwise, and directing preparation of plans and
specifications therefor;

YTHEREAS, the City Engineer has prepared and filed with
' the City plans and specifications for such improvements, and
same have been examined and approved;
THEREFORE, BE IT RTSOLVED BY THE CITY OF LITr POCF_, TEF„y S :
1.
That said plans and specifications be and the same are
hereby adopted and approved.
11.
That the City Clerk be and he is hereby directed to adver-
tise for bids for the :raking and construction of such improve-
ments such advertisement to be published at least two times
in a newspaper published in and generally circulated in the
City of Lubbock, Texas, and the first of said advertisements shall
be published at least five days before the date of receivir_g and
opening bids.

RESOLUTICK., ACCE2TING II:-TROVEI ENTS ON A`VMI..UE "H" UNDERPASS,
AND APPROVING M&INTENANCE BOND.
' '=REAS, the City of Lubbock, heretofore entered into contract
with Panhandle construction Comoany for the making and construction
of street improvements on Avenue "H" Underpass, being described
as follows:
Being 119-211 feet North of the North property line of eighth
Street to 77j feet North of the North property line of Fifth
Street.
11,T REAS, the improvements upon the said Avenue "H" Underpass
have been completed and have been inspected and found to have been
constructed in accordance with the terms of said contract; are,
i?-ER^AS. said Panhandle konstruction Company has this day
filed with the City its bond for the maintenance and repair of
such improvements, and such bond, together with the Surety thereon,
has been examined and anproved.
TF—EREFORE, BE IT RESOLVED BY TRE CITY OF LUTPOCK, TF,YAS:
1.
That the Improvements on said -venue "H" Un3erpass be and the
same are hereby accepted.
