The Minutes of Regular t:eeting of January 22, 1931, and Rec- essed 3egular Meetings of Jan. 23rd and 31st and February 7, 1931, were read and upon motion by Mr. Benson, seconded by Mr. Roach, they were unanimously approved. AN ORDINANCE RECUIRING PAYMENT OF A LICENSE FEE OF FIVE ($5.00) ' DOLLARS PER DAY IN ADVANCE FOR ENGAGING IN THE BUSINESS Cy OPERATING A BOWLING ALLEY, OR A FIVE OR TE11 PIN ALLEY; MAKING IT UNLAWFUL FOR ANY PERSON, AGENT OR SERVANT TO OP7RATE OR ASSIST IN THE OPERATION OF SUCH BUSINESS, UNLESS SUCH LICENSE FEE HAS BEEN PAID IN ADVANCE, AND A RECEIPT ISSUED TH7REFOR BY THE CITY TAX COLLECTOR; AND FIXING A PENALTY FOR VIOLATION THEREOF. Benson, carried unanimously, it was ordered to reject road crossing at :venues "D" and "E" adjacent to Block 67, 7heelock Second Addition, across Fort ,:orth Z Denver city Ry. Company right-of-way. 'rhe matter regarding office space of Boy Scouts was discussed by 1,r. L.N. Clapp before the City Commission. after due discussion the City Commission instructed amity Manager J. Bryan i.tiller to :Trite Ir. T.A. 'Vihite a letter asking the Boy Scouts to vacate. Motion by Air. Bacon, seconded by Ir. Benson, carried unanimously, it was ordered to forward the �22,000.00 north of 6% 7+arrants recently purchased by the interest and Sinking 'und to the Mate Comptroller at Austin asking him to exchange them for 6,22,000.00 'Funding Warrants, cancelling and returning both Bonds and warrants to the Gity for completing records. Motion b;r is. Benson, seconded by Mr. Leaverton, carried unanimously, it was ordered to discontinue collecting franchise tax on motor vehicles and busses that operate inside the City Limits. chis done upon ruling by City Attorney, u,.L. F77= RESOLUTION :=REAS, the -tate Highway Department of the ,-tate of 'Texas is desirous of constructing State Highway no. 7 within the city of Lubbock, Texas, over what is known and designated as College Avenue, and, WHEREAS, the State Highway Department is desirous of receiving Federal Aid for the improvemen` of said ,ighway; and, ' :7HEREASS, the Bureau of Public toads of the _epartment of Agriculture of the United States of America will not participate in the construction of said Highway until and unless the city of Lubbock will agree to refrainTrom permitting encroachments upon the right-of-way of said above mentioned streets, and until and unless the cit;; of Lubbock will agree to refrain from rassing ordinances or laws fixing a speed limit of under trenty-five miles per hour on said above mentiozrad streets, and until and unless the city of Lubbock will agree to refrain from erecting signs, semaphores, and signals that will give preference to local routes or that will hinder or delay traffic on said above mentioned streets. THEREFORE, be it resolved by the City Commission of the city of Lubbock, that, for and in consideration of the State Highway Department of the State of lexas and the Bureau of Public Roads of the Department of Agriculture of the United States of America constructing said Highway No. 7, through the city of Lubbock over College Avenue, it hereby agrees with the "Cate Highway Department of the tate of,lexas and the Bureau of Public Roads of the Department of k,7riculture of the United States of America that it will not, in the future, permit encroachment on the right-of-way of said above mentioned streets; nor will it pass an ordinance or laws fixing a speed li-it on the above mentioned streets of under twenty-five miles per hour; nor will it allow the erection of signs, semaphores, and signals that will give preference to local routes which intersect ith said above mentioned streets nor that will slow up, hinder, or delay traffic on said above mentioned streets. The City further agrees that, for and in consideration of the above they will place stop signs on all streets intersecting or terminating on said above mentioned street and rigidly enforce same. This is to certify that the above resolution was adopted and passed at a Regular 1,:eeting of the City Commission of the City of Lubbock on this the 12th day of February, 1931. J.J. Clements Mayor. Pitts and Commiss- ioners Claude A. Burrus, J.T. Pinkston,.L. Brashear ani L.C. Denton, it was :roved by Claude Burrus, seconded by L.C. Denton, and unanimously carried that Judge L.L. Pitts be and he is hereby authorized and directed to enter into option contract with the C_ty of Lubbock as per terms of cop;- recorded herein upon the terms therein stated and to execute and deliver to the City of Lubbock lease or leases in the event the City of Lubbock pays the consideration therein called for within the time therein stated.
