ORDINANCE NO.7,017-00163
AN ORDINANCE OF THE CITY OF LUBBOCK,TEXAS,ADOPTING AN INTERIM
FUTURE LAND USE PLAN PURSUANT TO TEXAS LOCAL GOVERNMENT
CODE CHAPTER 213;PROVIDING A SAVINGS CLAUSE;PROVIDING A
CONSISTENCY IN APPLICATION CLAUSE;PROVIDING FOR PUBLICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City Council of the Cityof Lubbock(the "City Council") adoptedan update
to the 1974 Lubbock Comprehensive Plan and the 1983 Comprehensive Land Use Plan on
August 22, 1985 through Resolution No.2118 in order to promote the public health, safety,
andwelfareofthe citizensof Lubbock,Texasandto promotesound,long-range development;
and
WHEREAS,the City Council desires to updatethe comprehensive plan and comprehensive
landuseplan amended through Resolution No.2118 to,among other things,more accurately
reflect the currentstateof the Cityandto more specifically indicate the potential challenges
to and opportunities for the City's future growth; and
WHEREAS,the City Council has indicated its intent to use the professional services of a
planning consultant team (the "Consultant")in order to develop,facilitate,produce,and
deliver an update tothe City's comprehensive planand future landuse plan;and
WHEREAS,the City Council appointed the Comprehensive Plan Advisory Committee (the
"Committee"),an ad hoc committee of individuals representing various neighborhoods,
industries,professions,and other appropriate stakeholders,to guide the Consultant in its
development,facilitation,production,and delivery ofthe comprehensive planand future land
use plan;and
WHEREAS,the Consultant andthe Committee have met together,with the City Council,
with the Planning and Zoning Commission (the "Commission"),with City of Lubbock staff,
and with the citizens of Lubbock to discuss the comprehensive plan and the comprehensive
land use plan; and
WHEREAS,the Consultant and the Committee have requested that the Council adopt an
interim future land use plan (the "Interim Future Land Use Plan")to begin promoting sound,
long-range development in the City of Lubbock while the comprehensive plan is finalized by
the Consultant and the Committee;and
WHEREAS,the Interim Future Land Use Plan was reviewed by the Commission at its
December 5,2017 meetingafterthe Commission helda publichearingonthe Interim Future
Land Use Plan;and
WHEREAS,the City Council finds and determinesthat it is in the best interest ofthe health,
safety,and welfare of the citizens of the City of Lubbock to adopt the Interim Future Land
Use Planin orderto begin promoting sound,long-range development intheCityof Lubbock
until the comprehensiveplan is adoptedby the CityCouncil;and NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Interim Future Land Use Plan, a copy of which is attached to this
Ordinance as "Exhibit A," and which is hereby made a part of this Ordinance, is found by the
City Council of the City of Lubbock to be true and correct, and found to serve the public
purpose of promoting sound, long-range development in the City of Lubbock until such time
when the City Council shall adopt the comprehensive plan and the future land use plan.
SECTION 2. THAT the Interim Future Land Use Plan shall be used to guide all matters
relating to zoning decisions, land subdivision, land use planning, and growth management for
the City of Lubbock until such time when the City Council shall adopt the comprehensive plan
and the future land use plan.
SECTION 3. THAT should any paragraph, section, sentence, phrase, clause or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the intent of this Ordinance is to apply consistent changes to any portion
of the Code of Ordinances of the City of Lubbock that is or may be affected by the changes
provided herein. This Ordinance is also intended to apply consistent changes to any Ordinance
that has been approved by the City Council of the City of Lubbock that is or may be affected
by the changes provided herein. If this Ordinance has omitted any portion of the Code of
Ordinances or any other Ordinance that should otherwise be affected by the changes provided
herein, such omission is inadvertent and unintentional, and, upon the effective date of this
Ordinance, any such omitted portion of the Code of Ordinances or other Ordinance shall be
interpreted in such a manner as to comply with the changes provided herein.
SECTION 5. THAT the City Secretary of the City of Lubbock is hereby authorized and
directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
SECTION 6. THAT this Ordinance shall become effective on February 1, 2018.
AND IT IS SO ORDERED.
