RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and
on behalf of the City of Lubbock a Dedicatory Certificate, associated Easements, and all
related documents in connection with a property described as Lots 305-A and 305-13, Midway
Park Addition, Lubbock County, Texas, located north of Marsha Sharp Freeway and east of
29th Drive, of the City of Lubbock, Lubbock County, Texas and all related documents. Said
Dedication Deeds and Easements are attached hereto and incorporated in this Resolution as if
fully set forth herein and shall be included in the minutes of the Council.

previously unplatted tract of land located in Section 17, Block B
Members of the Commission:
We have examined title to the property which is being replatted as captioned above, and find that
title is vested in CITY OF LUBBOCK, a Home Rule Municipal Corporation of the County of Lubbock,
State of Texas, subject to the following:
1. A gas pipeline right-of-way was granted to Pioneer Natural Gas Company in the Southwest
portion of Lot 305 in Document recorded in Volume 922, Page 687 of the Deed Records of
Lubbock County, Texas.
2. Subject to the Property having frontage or abutting Marsha Sharp Freeway, which is a
controlled access highway, set forth in Quitclaim Deed recorded in Volume 6729, Page 1
of the Real Property Records of Lubbock County, Texas, and Deed — Controlled Access
Highway Facility recorded in Volume 7439, Page 76 of the Official Public Records of
Lubbock County, Texas, and the exercise of power by the State of Texas pertaining to
controlled access highways as set forth in Chapter 203 of the Texas Transportation Code.
Any potential leases regarding, or rights of access to, the Southwest portion of proposed Lot
305-A under leases or contractual rights with the City of Lubbock as owner/landlord.
There is no lienholder of record against the referenced property.
This letter certifying ownership is provided on behalf of City of Lubbock, a Home Rule Municipal
Corporation of the County of Lubbock, State of Texas, and shall inure solely to the benefit of the City of
Lubbock. The information provided in this letter shall be relied upon solely for the purpose of replatting the
referenced property, and the dedication of any portion of the property within the plat limits for public uses.
The mineral estate has not been examined. This law firm assumes no liability or responsibility for the use
of the information supplied in this letter, or reliance thereon, for any other purpose.
When you have in hand all of the other instruments necessary, it will be in order for you to file this
document for record.

This is to certify that CITY OF LUBBOCK, a Home Rule Municipal Corporation of the
County of Lubbock, State of Texas, is the owner of a tract of land described as follows, to -wit:
METES AND BOUNDS DESCRIPTION of the plat limits of Lots 305-A and 305-B,
Midway Park Addition to the City of Lubbock, Lubbock County, Texas, a replat of Lot
305 and a previously unplatted tract of land located in Section 17, Block B, Lubbock
County, Texas, being further described as follows:
BEGINNING at a 1/2" iron rod with cap marked "HUGO REED& ASSOC." set in the
East right-of-way line of 29th Drive, dedicated by plat recorded in Volume 2485, Page 78
of the Real Property Records of Lubbock County, Texas (RPRLCT), at the Southwest
corner of Tract "A", Adventure Park, an addition to City of Lubbock, Lubbock County,
Texas, according to the map, plat and/or dedication deed thereof recorded under County
Clerk File Number (CCFN) 2017009165 of the Official Public Records of Lubbock
County, Texas (OPRLCT), for the most Westerly Northwest corner of this tract;
THENCE N. 01045'06" E., along the Southern boundary of said Tract "A", a distance of
15I.85 feet to a 1112" iron rod with cap marked "HUGO REED& ASSOC." set for the
most Northerly Northwest corner of this tract;
THENCE N. 55045'08" E., continuing along the Southern boundary of said Tract "A", at
419.50 feet pass an "x" cut in concrete found at a corner of said Tract "A" and the South
line of a 20 foot alley, dedicated by plat recorded in Volume 2485, Page 78, RPRLCT,
continuing along said alley, for a total distance of 545.14 feet to a point for the most

200.06 feet pass a point in the North right-of-way line of Marsha Sharp Freeway (U.S.

250.07 feet to an "x" cut in concrete set for the Southeast corner of this tract;
THENCE S. 55044'22" W., continuing along the North right-of-way of said Marsha
Sharp Freeway (U.S. 62/82), a distance of 606.87 feet to a 1/2" iron rod with cap marked
"HUGO REED& ASSOC." set in the North right-of-way line of Marsha Sharp Freeway,
dedicated in Volume 7439, Page 76, OPRLCT, for the most Southerly Southwest corner
of this tract;
THENCE N. 81009'22" W., along the North right-of-way line of said Marsha Sharp
Freeway (U.S. 62/82), a distance of 51.42 feet to a 1/2" iron rod with cap marked
"HUGO REED& ASSOC." set in the East right-of-way line of said 29th Drive for the
most Westerly Southwest corner of this tract;
THENCE N. 34015'12" W., along the East right-of-way line of said 29th Drive, a
distance of 102.23 feet to the Point of Beginning.;
and the undersigned wishes to re -plat the above described property, designating streets, alleys, easements
(surface and/or underground), and other public properties shown in accordance with the attached map,
prepared by Brent Carroll, Registered Professional Land Surveyor No. 5410, on the day of
, 20 , and approved by the Planning Commission of the City of Lubbock on the
day of , 2 , and desiring to have said property platted and duly filed for

these presents does impress the name of "LOTS 305-A and 305-B, MIDWAY PARK ADDITION to
the City of Lubbock, Lubbock County, Texas, a replat of Lot 305, and a previously unplatted tract
of land located in Section 17, Block B" upon said property for the correct reference and description
thereto by lots as indicated upon the attached map, and the undersigned does hereby adopt the name
hereinabove stated and impresses the same upon said land, incorporating said map as a part of this
dedication.
