IMPROVING NORTH FIRST STREET AND BROADWAY IN THE CITY OF LUBBOCK BY
CONSTRUCTING AND PUTTING IN FOURTEEN FOOT CONCRETE SIDEWALKS IN FRONT

THEREOF AND FIXING THE TIME AND PLACE FOR SUCH HEARING: --
BF IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK,' TEXAS: -
Whereas, the City Council has heretofore, by resolution
directed the improvement of North First Street and Broadway by the con-
struction of fourteen foot concrete sidewalks in front of and abutting

on Broadway; and, ivhcroaa, thereafter plans and specifications were pre-

pared by L ;1.1 __Hitchcock, consulting engineer, for said improvem(bnois
, and advertisements were made for bids therefor, and thereafter bila
were received therefor, and opened and considered by the City Council and
thereafter the bid of Wilmer -ring and Mullen for the said worg of improve-
ment was adopted by the Council; and, whereas, thereafter said Engineer
prepared and filed with the Council his report, stating the total cost of
such improvement and the proportion of such costs payable by kks each
owner of said abutting property and the costs of such improvement per
front foot of abutting property, and the names of the persons, firms,
corporations and estates owning the property abutting on the proposed im-
provement, with a description of their property, and the total costs of
such improvement to each parcel of property; and, whereas, said report
was approved by the Council by resolution; and,
Whereas„ the City Council has finally determined to assess the cost
of said improvement against the owners of the said abutting property and
their property: -
1. That it is finally determined hereby to assess the cost of said

improvement against the owners of the property abutting upon said streets
and their property, as herein provided. That a hearing shall be given be-
fore the City Council to the owners of said abutting property, their at-�
torneys or agents, which hearing shall be held in at the Council Chamber
in the City of Lubbock, Texas, on the. _day of December, A.8.1011,
at_ --o'clock -M., and shall continue from dayx1axAzy time
to time and day to day, until all persons interested in said property
shall be fully heard, at which time the owners of said property or any
person interested therein shall be entitled to a hearing as to the bene-
fits
enefits of said improvements to their property or as to any invalidity or
irregularity with reference to said proceedings or as to any other matter
of objection connected with the said izpxsx proceedings, and at which
hearing said owners or any other person interested in said property may
produce evidence in support of any objections.
2. That, after said hearing, said Council will, by ordinance, as -
sees against the ownersof said property and their property, such sums as
shall be determined to be just and equitable, and that said assessment will
be made in accordance with the front,,plan`and rule, as the frontage to
each owner is to the whole fronting to be improved, provided if the said
rule or plan shall be determined in any case to be unjust or inequitable,
then that the Council will adopt such rule of appartionment as shall be
just and equitable, having in view the benefits to each owner and burdens
imposed upon them, provided that no'assessment shall be made against any
owner or his property in excess of the benefits to said property in the
enhanced value thereof by reason of said improvement.

4. That the City Secretary of the City of. Lubbock is hereby
directed to give notice hereof by publication of this Resolution, signed
by him, which publication shall be by advertisement inserted three times
in The Lubbock Avalanche, px'hiiakad a n,wspaer I published in said City of
Lubbock, the first publication of which shall be at least ten days before
the date of the aforesaid hearing, and such notice will be further given
by the City Secretary mailing a copy of hereof, signed by him, by register—
ed mail to each of said owners at their addresses, if known, or if unknown,
then to their agent or attorney, if known, which said notice shall be de—
posited in the Post Ofice of the City of Lubbock at least ten days before
the date set Cor said hearing aforesaid.

passage.
On motion duly seconded the Council adjourned subject to the
call of the Mayor.
