PREPARATION OF PLANS AND SPECIFICATIONS:

PARATION OF PLANS Al`SD SPECIFICATIONS"; and,
AIEREAS, it is deemed advisable and necessary that the
streets and avenues therein ordered improved be arranged
in units or districts, and numbered as hereinbelow set forth,
in lieu of the arrangement and numbering as set forth in said
original resolution:
THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK,
TEXAS; THAT,
I.
Said original resolution omitting the caption and enact-
ing clause thereof, be and the same is hereby amended so that
same shall hereafter be and read as follows:

Public necessity exists that the following portions of
streets and avenues in the City of Lubbock, Texas, be improved
as herein provided, to -wit:
TEXAS AV1TUE (Formerly Avenue I) from its intersection
with the Y orth property line of 14th Street to its
intersection with the forth property line of 16th
Street, known and designated as Unit or District I;o. 1.
TEXAS AVEg7,JE (Formerly Avenue I), from its intersection
with the South property line of 16th Street to its
intersection with the South property line of 19th
Street, known and designated as Unit or District o. 2.
AVENUE G, from its intersection with the Iorth property
line of 10th Street to its intersection with the center
line of 8th Street, known and designated as Unit or
District Io. 3.
EIGHTH STREET, from its intersection with the East
property line of Avenue H to its intersection with the
center line of Avenue G, known and designated as Unit
or District iso. 4.
NINETEEP?TH STREET, from its intersection with theViest
property line of Texas Avenue, to its intersection with
the center line of Avenue I:°, known and designated as
TJnit or District ;o. 5.

Last property line of college Avenue, known and
designated as Unit or District ,0. 10.
AVIZIUE H, from the South line of the right-of-way of
Panhandle & Santa Fe Railroad to its intersection with
the South property line of Fourth Street, Down and
designated as Unit or District I1"o. 11.
AV-=U,H, from its intersection with the South property
line of 4th Street to its intersection with the ITorth
property line of First Street, known and designated
as Unit or District 11o. 12.

1herever in the foregoing it is ordered that streets
or avenues be improved to the center of intersection with
some other street or avenue, it is the intention that the
entire intersection be improved, and that half of the cost
of such intersection be prorated to one such street or avenue
and the other half to the other such street or avenue.
II.
Said portions of streets and avenues shall be improved by
raising, grading, and filling safe, and by installing concrete
curbs and gutters, and storm sewers and drains where necessary,
and by paving with one of the following types of material on
proper foundation, to -wit:
(a) Vertical Fibre Brick,
(b) Rock Asphalt,
(c) Warrenite Bitulit hic.

the exact type of pavement to be determined by the Commission
of the City of Lubbock after receipt of bids.
III.
The City Engineer is hereby directed to prepare plans and
specifications for such improvements embracing specifications
for each of the said types of paving.
IV.
Such improvements in each Unit or District shall be paid
for in the following manner:
(a) Railways and street railways using, occupying-, or
crossing any portion of said streets and avenues to be improved
shall pay for and be assessed for all the cost of work in the
area between their rails and tracks, double tracks, turn-
outs, and switches, and two feet on each side thereof.
(b) The abetting property and owners thereof shall pay and
shall be assessed for all the cost of constructing curbs in
front of such respective properties, and 90-, of the remaining
cost of such improvements, after deducting the sums to be paid
by railways and street railways under sub -paragraph (a) above,
provided that if it shall appear at the hearing to be had
before final assessment that the special benefits to such pro-
perty in the enhanced value thereof by means of such improvements
will not aggregate such proportion of costs, then there shall be
assessed and be paid by such abutting property, and the owners
thereof, the amount of such benefits.
(c) The remaining cost of said improvements, after deducting
the sums finally assessed against railways and street railways
under sub -paragraph (a) hereof, and against abutting property
and the owners thereof under sub -paragraph (b) above, shall
be paid by the City of Lubbock.
V.
The amounts to be paid by and assessed against railways and
street railways for work between rails and tracks and two feet
on each side thereof, shall be payable on estimates as the
work progresses, as may be provided in such specifications,
and shall bear interest from date due and until paid at the rate

of 7c,,o per annum. The amounts to be assessed against and paid by
abutting property and the owners thereof in each unit shall be
payable in six equal installments, due respectively on or before
to days, 1, 2, 3, 4, and 5 years after the completion and ac-
ceptance by the city of the improvements in the unit upon which
the property abuts, and shall bear interest from date of such
completion and acceptance and until paid at the rate of 71'-0
per annum, payable-.fnnually, with provision that if default be
made in the payment of any installment promptly as the same
matures, then at the option of the holder of any such assessment
or certificate issued in evidence thereof, such default shall
mature the entire assessment upon which same is made.
VI.
Assessments shall be made and levied and shall be a first
and prior lien and personal liability for principal, interest,
reasonable attorney's fees and costs of collection, if incurred,
all under and in accordance with the Charter, and amendments
thereto, now in force in this city.
VII.
his resolution shall take effect and be in force from
and after its passage.

RESOLUTION APPROVILTG CONTRACT AI`TD BOND OF
PANHANDLE COT S TRUC T ION COMPANY, AND DI RLC TING THE
IVILYOR TO EXECUTE SAME, AND MAKING APPROPRIATION?
THEREFOR.
WHEREAS, the City Commission of the City of Lubbock has
heretofore ordered that portions of Texas Avenue, and sundry
other streets d avenues, in the City of Lubbock, be improved
by raising, grging and filling, and installing concrete curbs
and gutters, any paving, and constructing storm sewers, and
otherwise, and.after preparation of plans and specifications
and dueadvertisement for and receipt of bids, accepted bid
of Panhandle Construction Company, and awarded contract to it;
and,
VrHERZAS, contract of said Company for the making and
construction of such improvements dated this, the a� day of
January, 1927, and already executed by said Company, and
together with bond for the performance of said pontract execut-

examined and approved: h -
THEREFORE, BE IT RESOLVED by the City of Lubbock,
Texas, that:
I.
Said contract and said bond be and they are hereby
approved, and the i;ayor of the City is authorized and directed
to execute same in the name of the City, and the City Secretary
to attest same and impress ti:ereon the corporate seal.
II.
That there be and is hereby appropriated out of available
funds and revenues sums sufficient to pay for and defray the
part of the cost of said improvements to be paid by the City.
This resole.tion shall take effect and be in force from and
after its passage.
